WHEREAS, the City Council of the City of Beaumont deems
it necessary that M. L. King, Jr. Pkwy./Spur 380, in the City of
Beaumont, Jefferson County, Texas be located, constructed, widened,
extended and maintained; and,
WHEREAS, said City Council has found that a public
necessity exists requiring the location, construction, widening,
extension and maintenance of said street on the hereinafter
described property; and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction, widening,
extension and maintenance of said street, and has found and
determined that said interests in and to the hereinafter described
land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the hereinafter described land and has been unable to
agree with such owners of such property as to the fair market value
thereof and damages, if any;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF �BEAUMONT:
THAT the City Attorney be, and he is hereby, authorized and
directed to file or cause to be filed against all owners of the
following parcels of land, and all claimants of any interest
therein, proceedings in Eminent Domain to acquire fee title for
said purposes, in and to the said parcels of land described in
Exhibit "A" attached hereto and made a part hereof, the parcel of
land being situated in Beaumont, Jefferson County, Texas.

Being 0.0610 acres of land, more or less, out of Lot 7, Block 30 of the Calder
Addition to the City of Beaumont, Jefferson County, Texas, according to a map or
plat of said Addition recorded in Volume 2, Page 115, Deed Records of Jefferson
County; and being part of the same land described in a deed from Elsie B.
Pearce, feme sole to Johnie J. Defatta, dated February 23, 1976, as recorded in
Volume 2175, Page 104, Deed Records of Jefferson County, Texas, said 0.0610
acres of land, more or less, being more particularly described by metes and
bounds as follows:
Commencing at the northeast corner of Lot 7, Block 30, of said Calder Addition;
Thence South 3'34'44" East along the east line of Lot 7 a distance of 116.24
feet to a point in the proposed east right of way line of Spur 380, same being
the Point of Beginning;
Thence South 3'34'44" East along the .east line of Lot 7 a distance of 23.76 feet
to the southeast corner of said Lot 7; same lying in the north right of way line
of South Street;
Thence South 86'23'16" West along the north right of way line of South Street a
distance of 50.00 feet to the southwest corner of said Block 30;
Thence North 3'34'44" West along the east right of way line of Oakland Street a
distance of 82.49 feet to a point for corner in the proposed east right of way
line of Spur 380;
Thence South 44'00101" East along the proposed east right of way line of Spur
380 a distance of 77.11 feet to the Point of Beginning and containing 0.0610
acres of land, more or less.
