R E S O L U T I O N
WHEREAS, Timothy Clark, owner, has requested the City
of Beaumont to allow him to encroach onto the city' s fifteen foot
(15 ' ) utility easement at the rear of Lot 4 and the south one
foot (1 ' ) of Lot 5, Block 6 , Dowlen West, Unit 4 (880 Norwood
Drive) for a swimming pool encroaching 1 .9 feet by 27.0 feet and
the concrete decking is encroaching 5.1 feet by 40.0 feet into
the utility easement, as depicted on Exhibit "A" attached; and,
WHEREAS City staff has expended considerable time and
effort in investigating the effect of such encroachment upon the
City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow
such encroachment at this time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License
to Encroach for Timothy Clark, owner, to encroach into the city's
utility easement at the rear of Lot 4 and the south one foot (1 ' )
of Lot 5, Block 6, Dowlen West, Unit 4 (880 Norwood Drive) for a
one-time fee of Five Hundred Dollars ($500 ) .
