BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute
an overhead electrical easement to Gulf States Utilities Company
and an equipment station easement to Southwestern Bell Telephone
Company on city-owned property out of the David Brown League,
Abstract No. 5, as shown on the attached Exhibits "A" and "B" .
PASSED BY THE CITY COUNCIL of the City of Beaumont this

THIS EASEMENT, entered into by the undersigned, herein referred ton as consideration of and SOUTH- N
WESTERN BELL TELEPHONE COMPANY, GRANTEE, wherein GRANTORS, -Dollars ($ 10 . 00 CID

and other valuable consideration, receipt of which is hereby acknowledged, do by these presents GRANT, BARGAIN
AND SELL, CONVEY AND CONFIRM unto GRANTEE, its associated and allied ompanies its a d their

successors and assigns, a permanent right and easement to construct, operate, 9e Jefferson e
remove a communications equipment station upon the following described land, situated in �
County, Texas, and described as follows: hJ
Being a 100 . 00 square foot tract or parcel of land situated
in the David Brown League , and out of and a part of that certain
Tract 1 , Plat Q according to the City Plats in the office of the
Tax Assessor Collector of the City of Beaumont , Jefferson County,
Texas as described in deed from Mike A. Grant , Jr . to the City of
Beaumont , dated January 29 , 1980, recorded in Volume 2210 , Page
348 of the Deed Records of the aforesaid county and state; to
which reference is hereby made for a more particular description
of the land made subject to this easement .
COMMENCING at the intersection of the East right-of-way line
of Pennsylvania Street and the South right-of-way line of the old
Buford Street;
THENCE East , along and with the South right-of-way line of old
Buford Street , for a distance of 221 . 70 feet to the POINT OF BEGINNING
of the herein described tract , marked by an iron rod set for corner;
THENCE continuing East , along and with the aforesaid South right-
of-way line , for a distance of 10 .00 feet to an iron rod set for
corner;
THENCE South for a distance of 10 . 00 feet to an iron rod set
for corner ;
THENCE West for a distance of 10 . 00 feet to an iron rod set
for corner;
THENCE North for a distance of 10 . 00 feet to the PLACE OF
BEGINNING and containing 100 . 00 square feet, more or less , in
easement .
TO HAVE AND TO HOLD the same, together with all rights and appurtenances to the same belonging, unto
Grantee, and to its successors and assigns forever, including (1) the right to connect said station with the Grantee's
communications systems by means of aerial and underground cables, wires and antennas, (2) the right to enclose said
land with a fence, (3) the right of ingress and egress to and from said station by reasonable routes across the
adjoining property of the Grantors, (4) the right to construct, improve and maintain a roadway suitable for vehicular
traffic ---------0----------feet wide to said station, 15) the right to construct, operate and maintain, or
license others to do so, service lines for electric power and telephone upon, over and under said roadway,.(6) to
install gates in any fences crossing said roadway, and (7) to clear and keep cleared all trees, overhanging branches,
roots, brush and other obstructions from said land and roadway.
Grantors covenant that they and their heirs, successors, administrators and assigns, shall and will WARRANT
AND DEFEND the title to the premises unto the said Grantee, and to its successors and assigns forever against the
lawful claims of all persons whomsoever; and further that the Grantee, its successors and assigns, may quietly enjoy
the premises for the uses herein stated.
