R E S O L U T I O N
WHEREAS on April 12 , 1988, a contract was executed with
Baytown Construction Company in the amount of $74,983. 00 for
Caldwood and Ida Reed Parrs playground improvements; and.,
WHEREAS, on July 11 , 1988 , the City Manager authorized
Change Order No. 1 increasing one of the playground Modules for
$675 .00 ; and,
WHEREAS, construction is now complete at a final
estimate of $75, 658. 00 ; and,
WHEREAS, the project has been inspected by the
Parks Division and is in conformance with the plans and
specifications;
WHEREAS, during final inspection of the project, it was
determined that Baytown Construction Company did not utilize the
MBEs indicated on documents submitted by Baytown Construction
Company and did not meet its MBE requirements;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT
THAT the City Manager be, and he is hereby, authorized to accept
the project and make final payment to Baytown Construction
Company in the amount of $3 ,782 . 90 for Caldwood and Ida Reed
Parks playground improvements.
BE IT FURTHER RESOLVED that, as a result of the breach
of the MBE commitment, Baytown Construction Company be suspended
from bidding on City projects for a period of twelve ( 12 ) months
effective November 1 , 1988.
