R E S O L U T I O N
WHEREAS, in April of 1988, the City of Beaumont entered
into a contract with Applied Products (now Toter, Inc. ) to
furnish and deliver to residences 35,000 automated containers in
July and August; and,
WHEREAS, in May of 1988, the citizens of Beaumont
passed a referendum requiring twice a week collection
necessitating implementation of the automated system by areas of
Beaumont and the purchase of additional trucks to arrive in
December, 1988, ; and
WHEREAS, to insure timely delivery of containers in
December, the City of Beaumont has requested that Toter assign
the delivery portion of the contract to their subcontractor, J.
Allen Contractors, Inc. ; and,
WHEREAS, the assignment will result in a reduction in
the cost of the containers of $2.50 each;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to approve
the assignment by Toter, Inc. of the delivery portion of the
Toter contract to J. Allen Contractors, Inc. , and pay J. Allen
contractors under said assigned portion of the contract $2.50 per
container upon successful delivery.
PASSED BY THE CITY COUNCIL of the City of Beaumont this
