HomeMy WebLinkAboutRES 88-013 R E S O L U T I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to accept the deed, a copy of which is attached hereto as Exhibit "A" for all purposes, from Ben Rogers, Trustee, M. A. Phelan, Trustee, and the Beaumont Housing Authority for the property generally described as the sixty foot (60 ' ) wide right-of-way for Arthur Street from approximately 441 feet east of the intersection of West Lucas Drive, eastward a distance of 186.36 feet. BE IT FURTHER RESOLVED that the City Manager accept the deeds from Ben J. Rogers, Trustee and M. A. Phelan, Trustee for the property generally described as the sixty foot (60 ' ) wide right-of-way for Folsom Drive from 232. 53 feet east of West Lucas Drive eastward a distance of approximately 223 feet. Phelan, Trustee; Housing Authority of the City of Beaumont, a public body corporate; and Ben J. Rogers, Trustee, of the County of Jefferson, State of Texas, hereinafter called GRANTORS, for and in consideration of the sum of ONE DOLLAR ($1.00) and other good and valuable consideration, to me in hand paid by the City of Beaumont, for the conveyance of the hereinafter described property, the receipt and sufficiency of which is hereby acknowledged and confessed, has GRANTED, SOLD and CONVEYED, and by these presents do GRANT, SELL and CONVEY unto the said City of Beaumont, P. 0. Williams Survey, Beaumont, Jefferson County, Texas and being part of Arthur Street as shown on the Replat of Block 11 French Heights Addition, according to the Map thereof recorded in Volume 8, Page 31 of the Map Records of Jefferson County, Texas and also being part of Arthur Avenue abandoned by City of Beaumont Ordinance No. 67-39 dated June 27, 1967 and said 0.257 acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at an iron rod set at the intersection of the North right-of-way line of Arthur Avenue (60 foot right-of-way) and the East line of a 15 foot wide Drainage Easement as shown on said Map of French Heights Addition and said iron rod being the Northwest corner of said abandoned Arthur Avenue; THENCE North 89 deg. 52 min. East along the North right-of-way line of now abandoned Arthur Avenue and along the South line of a 1.35 acre tract of land described in deed from Ben J. Rogers, Trustee to M. A. Phelan, Trustee dated June 27, 1978 and recorded in Volume 2084, Page 348 of the Deed Records of Jefferson County, Texas a distance of 186.36 feet to an iron rod found at the South- east corner of said 1.35 acre tract of land; THENCE South 00 deg. 37 min. East along the projection of the East line of said 1.35 acre tract of land a distance of 60.00 feet to an iron rod set; THENCE South 89 deg. 52 min. West along the South right-of-way line of said now abandoned Arthur Avenue a distance of 186.36 feet to an "X" set in the steel top of a sanitary sewer lift station in the East line of said 15 foot wide Drainage Easement; THENCE North 00 deg. 37 min. West along the East line of said Easement a distance of 60.00 feet to the PLACE OF BEGINNING and containing 0.257 acres of land. Exhibit "A" AND whereas the City of Beaumont on June 27, 1967 passed Ordinance Number 67-39 vacating and abandoning that same portion of Arthur Avenue as described above and whereas the property owners now wish the street to be open. ` This conveyance is made subject to all zoning laws and to restrictions, covenants, conditions, easements and mineral and/or royalty reservations, if any, effecting this property. TO HAVE AND TO HOLD the above described premises together with all and singular the rights and appurtenances thereto and in any wise belonging unto the said City of Beaumont, Texas, its successors and assigns, save and except the following reservation: The GRANTORS reserve all of the oil, gas and sulphur in and under said land, but waive all rights of ingress and egress to or from the surface of said land for the purpose of exploring, developing, mining or drilling for the same. AND said GRANTORS herein, do hereby bind themselves, their successors and assigns, to WARRANT AND FOREVER DEFEND all and singular the said premises unto the said City of Beaumont, Jefferson County, Texas, and its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the reservations from and exceptions to conveyance and warranty, when the claim is by, through, or under grantors but not otherwise.
