R E S O L U T I O N
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a renewal to
the contract between the City of Beaumont and Bevil Oaks for EMS
services to be provided within Bevil Oaks substantially in the form
attached hereto as Exhibit "A" .

CONTRACT
THE STATE OF TEXAS
COUNTY OF JEFFERSON
WHEREAS, the City Council of the City of Beaumont by resolution has authorized
its City representative, the City Manager, to execute a two-year contract with the
City of Bevil Oaks to provide emergency medical services to Bevil Oaks; and,
WHEREAS, emergency medical services are to be provided by employees of the City,
formerly known as the Beaumont Emergency Medical Services Corporation, a Texas
nonprofit corporation; now, therefore:
THIS AGREEMENT, made and entered into this day of , 1987,
by and between the City of Beaumont, a municipal corporation of the State of Texas,
hereinafter called "City", acting herein by and through its duly authorized City
representatives, and the City of Bevil Oaks, a municipal corporation of the State of
Texas, hereinafter called "Bevil Oaks", acting herein by and through its duly
authorized City representatives.
W I T N E S S E T H
1.
City shall provide emergency medical services for the sick, injured, afflicted or
disabled persons under emergency conditions within Bevil Oaks. City does hereby agree
to accept such engagement and employment and to discharge such duties in accordance
with the terms and conditions herein set forth.
2.
City shall provide emergency medical services to Bevil Oaks when requested and as
personnel and equipment are available to respond to said requests; however, City shall
use due diligence to provide prompt response to said requests. Requests for
transportation of nonemergency patients will not be accepted.

Bevil Oaks shall pay the City for emergency medical services. The total contract
amount to be paid by Bevil oaks during the term of this two (2) year contract is Three
Thousand Nine Hundred Eighteen Dollars ($3,918.00) .

Bevil Oaks hereby agrees to indemnify and save harmless the City from any and all
claims, causes of action, and damages of every kind, for injury to or death of any
person and damage to property which might arise as a result of joint or several acts,
omissions or negligence of Bevil Oaks or their employees or agents.
5.
Bevil Oaks shall comply with all laws applicable to its activities.
6.
This agreement shall be deemed to be made and shall be construed in accordance
with the laws of the State of Texas and shall be performable in Jefferson County,
Texas.
7.
Either party may terminate this agreement by giving sixty (60) days written
notice to the other party. In the event this contract is terminated by either party,
the contract amount provided for in paragraph 3 above shall be prorated to the date of
termination.
8.
All notices required to be given hereunder by City to Bevil Oaks shall be in
writing by mail or telegram, postage prepaid, and addressed to Bevil Oaks as follows:

Terms of this agreement shall be in force from the lst day of January, 1987,
until the 31st day of December, 1989.
