BE IT RESOLVED BY THE CITY COUNCIU OF THE
CITY OF BEAUMONT:
THAT the proposed procedures and policies for notifying the public
of proposed governmental land development projects not governed by
the Zoning Ordinance, a copy of which is attached hereto as Exhibit
"A", be, and they are hereby, approved and adopted.

Policy Statement:
Public Notification Procedure for Governmental Land Uses
1) Written Notification. The City will notify, in writing, the owners of
property within 300 feet of the proposed project. If a public hearing is
being held by the Federal, State, or County agency involved, the City's
notice will be mailed at least 10 days prior to the hearing, providing that
the City has been notified of the hearing in sufficient time to meet this
requirement. If the City does not find out about the hearing in time to
meet the 10-day requirement, the notices will be mailed as soon as
possible.
Notices will go to property owners as listed on the most recent, available
tax rolls. Neighborhood associations or similar organizations within the
affected neighborhood will also be notified if the staff is aware of their
existence.
2) Sign. The City will post a sign on the subject property calling attention
to the proposed project, the name and address of the agency responsible for
conducting it, and the date of a public hearing (if any). The sign will be
posted in the public right-of-way immediately adjacent to the property line
if the owner of the proposed site will not allow the sign posted on his
property.
3) The Planning Division will monitor published Legal Notices to aid in the
execution of this policy.
4) These notification requirements will be suspended at the City Manager's
discretion in cases where public disclosure of a facility could endanger
the life, health, or safety of employees, residents, or clients of the
facility. An example of such a situation would be a shelter for battered
women and children.
5) These provisions will not be invoked for Group Homes for the
developmentally disabled, since a citizen's committee has been organized to
recommend policies and procedures to insure public understanding and
acceptance of the homes. A decision at this time to apply the proposed
notice requirements to Group Homes would be premature and would run counter
to the Council's desire to allow the citizen's committee to develop
guidelines for locating the homes.
