R E S O L U T I O N
WHEREAS, certain land uses which are operated by agencies
of the State of Texas such as restitution centers are allowed to be
located within a city without reference to zoning limitations;
and,
WHEREAS, in recognition of this freedom, State laws and
regulations require that a notice of the potential operation of
such land uses be provided to the area impacted by such uses by
publishing a notice in a newspaper of general circulation in the
county of the proposed location; and,
WHEREAS, it is the opinion of the City of Beaumont that
such notice requirements are inadequate to properly apprise the
residents of the city concerning the proposed location of the State
facility within the boundaries of such city; and,
WHEREAS, a procedure whereby a State agency proposing to
operate or locate such a facility is required to provide a written
notice to the city in which such facility is to be located would
provide an additional effective means of notice;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the legislature of the State of Texas is hereby requested to
examine and review the notice requirements which are presently
required prior to a decision to either locate or operate a State
facility within the city limits of a city and amend such
regulations to provide that an additional notice, in writing, be
provided to the city government of the city in which such facilities
are proposed to be located or operated.
