HomeMy WebLinkAboutRES 86-245 R E S O L U T I O N WHEREAS, the owner of property in Terrace Estates Addition has requested that the city abandon the east five (5 ) feet of a ten (10) foot wide utility easement in exchange for his granting a five ( 5) foot wide utility easement adjacent to the remaining west five (5 ) feet of the ten ( 10) foot easement; and, WHEREAS, a sanitary sewer line is located two (2 ) to three ( 3 ) feet within the easement and the exchanged easement would better facilitate maintenance on the line; and, WHEREAS, because of the time involved in processing the exchange through the Planning and Zoning Commission and then City Council, the owner is requesting that a temporary License to Encroach Agreement be granted, thereby enabling him to complete the sale of the property; and, WHEREAS, the license would expire when the easements exchange is completed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute a temporary License to Encroach Agreement on the east five (5 ) feet of a ten (10) foot wide utility easement in Lot 9 , Block 4, Terrace Estates Addition.
