WHEREAS, the City Council of the City of Beaumont deems
it necessary that right-of-way be obtained for the South Park
Drainage Relief Project in the City of Beaumont, Jefferson County,
Texas; and,
WHEREAS, said City Council has found that a public
necessity exists requiring the acquisition of said right-of-way for
the location, construction and maintenance of the South Park
Drainage Relief Project on the hereinafter described property;
and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction and maintenance
of said drainage project and has found and determined that said
interests in and to the hereinafter described land is suited for
such purposes and that it is necessary to acquire same for said
purposes; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the hereinafter described land and has been unable to
agree with such owners of such property as to the fair market value
thereof and damages, if any,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:

THAT the City Attorney, be and he is hereby authorized and directed
to file or cause to be filed against all owners of the following
parcel of land, and all claimants of any interest therein,
proceedings in eminent domain to acquire fee title for said
purposes, in and to the said parcel of land described in Exhibit
"A" attached hereto and made a part hereof, the parcel of land
being situated in Beaumont, Jefferson County, Texas.

FIELD NOTE DESCRIPTION OF A 0.80 ACRE TRACT OF LAND FOR THE SOUTH PARK DRAINAGE
RELIEF PROJECT OWNER: EPSILON ENDOWMENT FUND, INC..
BEING a 0.80 acre tract of land out of Lot 21 of the Annie T. Warren Subdivision,
according to the plat thereof recorded in Vol . 1, Page 71 of the Map Records of
Jefferson County, Texas and being out of that certain tract of land described in
deed from Sally Hunsucker to H. R. Hunsucker dated December 23, 1948 and recorded
in Vol . 723, Page 474 of the Deed Records of Jefferson County, Texas and said
0.80 acre tract of land being more particularly described by metes and bounds as
follows :
FOR locative corner begin at a 3/4 inch bolt found in the North line of the
Cardinal Square Apartment 8.787 acre tract of land locating the Southwest corner
of Lot 2, Block 3 of Virginia Addition, according to the plat thereof recorded in
Vol . 6, Page 60 of the Map Records of Jefferson County, Texas and locating the
Southeast corner of said H. R. Hunsucker tract of land;
THENCE South 89 degrees 18 minutes 58 seconds West along the North line -of said
8.787 acre tract of land and the South line of said H. R. Hunsucker tract of land
a distance of 183.37 feet to a 5/8 inch iron rod placed locating the Southeast
and the beginning corner of the tract of land herein described;
THENCE South 89 degrees 18 minutes 58 seconds West with the South line of said
Hunsucker tract and the North line of said 8.787 acre tract a distance of 70.00
feet to an iron stake for corner;
THENCE North a distance of 488.61 feet to an iron stake for corner placed in the
Southwost right-of-way line of West Virginia Street, said iron stake also lies in
the North line of said Hunsucker tract ;
THENCE North 89 degrees 10 minutes 58 seconds East with the South line of West
Virginia Street a distance of 70.00 feet to an iron stake for corner locating the
most Northerly Northeast corner of said H.R. Hunsucker tract;
THENCE South with the East line of said Hunsucker tract and its extension , a
distance of 488.77 feet to the place of beginning containing 0.80 acres of land .
