R E S O L U T I O N
WHEREAS, by letter dated February 26, 1985, the State
Department of Highways and Public Transportation (SDHPT) advised
the city that plans were being prepared for the reconstruction of
College Street from near Major Drive to IH-10; and,
WHEREAS, the city is responsible for the completion
and/or modification of the storm sewers, driveways, curbs and
gutters, removal and replacement of existing signals, and
adjustments to their water and sewer systems; and,
WHEREAS, the cost of the city' s portion of the
modifications at that date was estimated to be $800,000 ; and,
WHEREAS, on July 12, 1985, the city advised the State
Department of Highways and Public Transportation that we desired
the relocation of water and sewer lines be included in the highway
construction plans; and,
WHEREAS, upon agreement by the SDHPT, the City Council,
by Resolution 85-238, authorized the City Manager to enter into an
engineering services contract with Mark Whiteley and Associates to
prepare construction plans for' the required water and sewer line
relocation to be included with construction plans for the College
Street reconstruction; and,
WHEREAS, construction plans have now been completed and
construction estimates based on plan quantities show that the
portion to be financed from city TIP funds ( i.e . , curb and gutter
and storm sewers) is estimated to be $580, 388 and the portion to be
financed by city water funds ( i.e . , relocation of water and sewer
lines) is estimated to be $558,712 for a total amount of
$1, 139, 100; and,
WHEREAS, based on the estimated cost of $1 , 139, 100 for
the city' s share of the project, the state has submitted an
agreement to the city for execution by the City Manager in which
the state agrees to construct the project upon receipt of the
city' s warrant made payable to the SDHPT in the amount of
$1 , 139, 100 and the executed agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to enter
into an agreement with the State Department of Highways and Public
Transportation in the amount of $1 , 139, 100 for reconstruction of
College Street from near Major Drive to IH-10.
BE IT FURTHER RESOLVED that in the event the actual cost
of construction exceeds the escrow payment of $1 , 139, 100 the city,
upon request from the state, will supplement the escrow payment by
an amount to pay the actual cost of construction.
BE IT FURTHER RESOLVED that in the event that the escrow
amount exceeds the actual cost of construction, the excess amount
will be returned to the city.
