WHEREAS, the City Council of the City of Beaumont deems
it necessary that Spur 380 in the City of Beaumont, Jefferson
County, Texas be located, constructed, widened, extended and
maintained; and,
WHEREAS, said City Council has found that a public
necessity exists requiring the location, construction, widening,
extension and maintenance of said street on the hereinafter
described property; and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction, widening,
extension and maintenance of said street, and has found and
determined that said interests in and to the hereinafter described
land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the hereinafter described land and has been unable to
agree with such owners of such property as to the fair market value
thereof and damages, if any,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney, be and he is hereby authorized and directed
to file or cause to be filed against all owners of the following
parcel of land, and all claimants of any interest therein,
proceedings in eminent domain to acquire fee title for said
purposes, in and to the said parcel of land described in Exhibit
"A" attached hereto and made a part hereof, the parcel of land
being situated in Beaumont, Jefferson County, Texas.
PASSED BY THE CITY COUNCIL of the City of Beaumont this

BEING 0.2680 acres of land, more or less, out of a part of of that certain
tract of land in the David Brown Survey, Abstract-5, Jefferson County,
Texas, said tract of land being the same tract described in a deed from
Exxon Corporation to Bui Duc Hung, et ux, dated June 2, 1978, recorded
in Volume 2083, Page 249, Deed Records of Jefferson County, Texas, said
0.2680 acres of land, more or less being more particularly described by
metes and bounds as follows:
Commencing at the northwest corner of a tract of land conveyed to William
M. Wheat as recorded in Volume 1865, Page 8 of the Deed Records of Jefferson
County, Texas, Thence as follows;
South 87030'55" East along the north line of said Wheat tract a distance
of 139.80 feet to a point in the west right of way of Park Street;
Thence South 2031'59" West along the west right of way line of Park Street
a distance of 390.00 feet to the northeast corner of grantor's tract of
land and being the Point of Beginning;
Thence South 2031'59" West along the west right of way line of Park Street,
same being a grantor's east property line a distance of 154.60 feet to
a point for corner in the existing east right of way line of Railroad
Avenue;
Thence North 42004'06" West along the east right of way line of Railroad
Avenue same being grantor's south property a distance of 199.38 feet to
the southwest corner of grantor's tract of land;
Thence North 2031'59" East along the west line of said grantor's tract
a distance of 12.15 feet to a point for grantor's northwest property
corner;
Thence South 87039'56" East along the north line of grantor's tract a
distance of 140.00 feet to the Point of Beginning and containing 0.2680
acres of land, more or less.
