R E S O L U T I O N
WHEREAS, Mr . James Peterson has agreed to grant an
easement to a strip of land less than five (5 ) feet in width by
one hundred (100) feet in length as shown on the attached Exhibit
"A" to the City of Beaumont for roadway, drainage and general
utility purposes.
WHEREAS, the City Council has considered the purposes of
said easement is of the opinion that the acceptance of said lease
for right-of-way use is necessary and desirable and that same
should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Council hereby approves and accepts an easement, as
described on the attached Exhibit "A" , by Mr . James Peterson to
the City of Beaumont.
BE IT FUTHER RESOLVED that the City Manager be, and he
is hereby, authorized to execute a contract of sale for Eight
Hundred Sixty Dollars ($860) with Mr . James peterson on the same
property as shown on the attached Exhibit "B" .

That certain 0.011 acre tract of land described as being a portion of a 0.339
acre tract of land out of Block 3 of the W.W. Chaison Addition to the City of
Beaumont; said W.W. Chaison Addition being a part of the J . W. Bullock League,
Abstract 7 within Jefferson County, Texas and being a recorded plat in Volume 2,
Page I of the Jefferson County Map Records; said Block 3 being subdivided by
Instrument recorded: in Volume 91 , Page 395 of the Jefferson County Deed Records
and filed for record on August 7, 1906; said 0.339 acre tract having been conveve.c
from Golden Triangle Oil Company, Inc. to James Peterson by deed dated February I",
1977 and recorded in Volume 1983, Page 188 of the Jefferson County Deed Records;
said 0.011 acre tract being more particularly described by metes and bounds as
follows:
COMMENCING from an iron pipe found at the southeast corner of Lot 16
out of said Block 3 as subdivided by instrument recorded in Volume 91 ,
Page 395; said iron pipe also being at the intersection of the northerly
right-of-way line of Irby Street, a fifty (50) foot wide right-of-way,
and the westerly line of a fifteen ( 15) foot wide alley which has been
abandoned by ordinance of the City of Beaumont as recorded in Volume 65-Z,
Page 195 of the Deed Records of Jefferson County, Texas;
THENCE South 89° 19125" East along the said northerly right-of-way line
of Irby Street and the southerly line of said Block 3 as subdivided by
instrument recorded in Volume 91 , Page 395, a distance of 7.5 feet to a
point at the center line of the said fifteen ( 15) foot wide alley; said
point also being at the southwest corner of the said 0.339 acre tract;
THENCE continuing South 89° 19125" East along the said northerly right-
of-way line of Irby Street and the said southerly line of Block 3 a
subdivided by Instrument recorded in Volume 91 , Page 395, a distance
of 142.82 feet to an x marked in concrete on the proposed westerly
right-of-way line of Highland Avenue, an existing sixty (60) foot wiae
right-of-way; said x marked in concrete also being at the POINT 07
BEGINNING of this herein described tract;
THENCE North 00°40135" East along the said proposed westerly right-of-way
line of Highland Avenue, a distance of 100.00 feet to an iron rod set on
the northerly line of the said 0.339 acre tract;
THENCE South 89° 19125" East along the said northerly line of the 0.339
acre tract, a distance of 4.92 feet to an iron rod found on the existing
westerly right-of-way line of Highland Avenue and the easterly line of
said Block 3
THENCE South 00°34111" West along the said oxisting westerly right-of-way
line of Highland Avenue and the said easterly line of Block 3, a distance
Of 100.00 feet to a chipped hole found in concrete on the said northerly
right-of-way line of Irby Street; said chipped hole found In concrete
also being at the southeast corner of said Block 3 as described in Volume 91 ,
Page 395 of the Jefferson County Deed Records;
THENCE North 89°19125" West along the said northerly right-of-way line of
Irby Street, and along the said southerly line of Block 3 as described
in Volume 91 , Page 395 of the Jefferson County Deed Records, a distance
of 4.68 feet to the POINT OF BEGINNING, and containing 0.011 acres of
land.
