WHEREAS, the 19 .9 acres of land generally located on the
northeast corner of French Road and Delaware in the City of
Beaumont is under consideration for a zone change from RS
(Residential Single Family Dwelling) to OP (Office Park) district;
and,
WHEREAS, the City desires to maintain the park-like
feeling created by the existence of numerous mature trees of
several varieties; and,
WHEREAS, the surrounding area in the vicinity of these
same 19 .9 acres has been found to be subject to flooding caused by
an overloaded drainage system; and,
WHEREAS, development of the 19 .9 acres will require
particular attention to the design of a drainage plan which will
control storm run-off from the site; and,
WHEREAS, the City Council feels that it is in the best
interest of the City of Beaumont that storm drainage restrictions
be attached to the 19 .9 acres in the form of deed restrictions in
order to protect the health, safety, and welfare of its residents;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the following deed restrictions shall be included in the deed
to be executed by the City at the time of sale of the property in
order to accomplish those ends:
1 ) That the post development stormwater run-off be
limited to the predevelopme nt run-off rate with the
drainage design accomplishing this being submitted to
the City Engineer for approval prior to construction
and shall properly be in place prior to issuance of a
certificate of occupancy.
2) If, prior to development of the site, the City has
completed sufficient off-site drainage improvements
to correct the drainage problems in the vicinity of
the site and the City Engineer certifies that the
drainage system can accommodate run-off from the
proposed development, the site may be developed
without the restrictions on storm run-off stated
above, provided that plans for conveying run-off from
the site to the drainage system are approved by
the City Engineer.
3 ) Any improvements completed for the purpose of
conveying stormwater run-off shall be done in a
manner which protects the continued existence of
those areas designated as conservation easements.
