BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute a
lease agreement with the Civil Air Patrol, in the form attached
hereto as Exhibit "A" , for the lease of 0 .62 acres of land at the
Beaumont Municipal Airport for a period of five ( 5) years.

L E A S E
This Lease Contract dated this the day
of , 1984, by and between the City of Beaumont,
a Municipal Corporation domiciled in Jefferson County, Texas,
hereinafter called "Owner" and the Civil Air Patrol, hereinafter
called "Lessee".
W I T N E S S E T H
Owner does by these presents lease, let and demise
unto Lessee the following described property, to wit:
Beginning at the intersection of the Proposed
Building Restriction Line with the Future Right
of Way Line of Keith Road as shown on the attached
map which is attached hereto as exhibit "A".
THENCE, Northerly along said Future Right of Way
Line of Keith Road a distance of 270 feet to
a point;
THENCE, Westerly along a line perpendicular to
said Future Right of Way Line of Keith Road to
the intersection of the Proposed Building
Restriction Line (a distance of approximately
200 feet);
THENCE, Southeasterly along said Proposed Building
Restriction Line to the point of the beginning
(a distance of approximately 300 feet) and
containing 0.62 acres more or less.
for a term of five years, beginning on the first day of January,
1985 and ending on the 31st day of December, 1989, upon the
following conditions, obligations, and covenants:
1.
Lessee agrees to pay to owner as rent for said premises
the sum of $1.00 per year in advance, at the City Hall, in
Beaumont, Texas.
2.
Lessee shall use the property solely for civil air
patrol activities including but not limited to the location
of one or more mobile facilities to be moved on the property
by Lessee.

3.
Lessee agrees to adhere to all the ordinances of
the City of Beaumont specifically including those ordinances
regulating mobile homes. If sanitation facilities are provided
on the property they shall be installed and maintained as provided
by the ordinances of the City of Beaumont. Leasee agrees to
provide appropriate parking for the use of the facilities.

Lessee shall be responsible for the maintenance of
the lessed premises and agrees to keep all improvements placed
thereon in a good state of repair and in a clean condition,
and agrees to keep the parking area clean at all times and
properly surfaced so as to be useable.
5.
Lessee shall be responsible for the conduct of each
person using the facilities and the public while on said premises
and will insist on each such person observing all the ordinances
of the City of Beaumont and the laws of the State of Texas.
6.
Lessee agrees to pay all charges for water, gas,
electric power, and other utilities as incurred during the
term hereof, and at the expiration of this lease, Lessee shall
deliver the premises described herein to owner in a clean condition
and clear of all property, buildings, foundations, or rubbish.
7.
All improvements placed on the premises shall be
the responsibility of Lessee and shall remain the property
of Lessee and at the expiration of this lease term may be removed
by Lessee.
8.
It is specifically agreed by the parties hereto that
the use of beer, wine, and other liquors is prohibited on said
premises.
9.
Lessee shall indemnify, save, and keep harmless the
owner from all liabilities, claims, damages, judgements, injuries,
costs, and expenses which may in any manner come against owner
in consequence of or resulting from any operations that Lessee
may conduct or carry on the leased premises specifically including
any negligence on the part of owner, and Lessee shall carry
public liability insurance for bodily injuries on the premises
in the sum of $500,000, and property damages liability in the
sum of $50,000; the cost of said policy is to be born by the
Lessee, which shall cover owner as well as Lessee and a certificate
of said insurance shall be filed with the City Clerk of the
City of Beaumont. Insurance shall be so filed prior to Lessee
taking possession of the above described premises under this
lease.
10.
It is mutually agreed and understood between the
parties hereto that either party to this lease shall have the
right to cancel same for any reason whatsoever by giving the
other party notice in writing of its intention to cancel at
least ninety (90; days prior to the effective date of cancellation.
Upon notice of cancellation by owner or at termination of lease
in any other manner. Lessee agrees to remove all improvements.
EXECUTED in duplicate originals this the day
of , 1984 by owner, acting herein by and through
its City Manager, hereto and duly authorized, and Lessee acting
herein by and through its duly authorized officer.
