WHEREAS, the parcel of land described in the general
warranty deed attached hereto as Exhibit "A" was originally
acquired for Phelan Boulevard right-of-way purposes and is no
longer needed by the City of Beaumont; and,
WHEREAS, said parcel of land, because of its size and
shape, is incapable of being used independently as zoned and is an
uneconomic remnant and should be sold to the abutting property
owner; and,
WHEREAS, the abutting property owners are Gilson Viator
and Lucille West, of Beaumont, Jefferson County, Texas and,
WHEREAS, Gilson Viator and Lucille West have agreed to
pay the City of Beaumont $3 ,964. 42 for said property;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT :
THAT the City Manager be, and he is hereby , authorized to execute,
for and in behalf of the City of Beaumont, a general warranty deed
in substantially the form attached hereto as Exhibit "A" and in
consideration of $3 ,964. 42.

KNOW ALL MEN BY PRESENTS:
COUNTY OF JEFFERSON
WARRANTY DEED
THAT the City of Beaumont, a municipal corporation of
Jefferson County , Texas, for and in consideration of the sum of
THREE THOUSAND NINE HUNDRED SIXTY-FOUR DOLLARS AND FORTY-TWO
CENTS ($3 ,964. 42) and other good and valuable consideration paid
by the GRANTEE herein named, the receipt and sufficiency of
which are hereby acknowledged and confessed, has GRANTED, SOLD,
and CONVEYED, and by these presents does hereby GRANT, SELL, and
CONVEY unto Gilson Viator and Lucille West of Beaumont,
Jefferson County , Texas, subject to the reservations hereinafter
made, all of that certain real estate ( the "Property" ) lying and
being situated in Jefferson County , Texas, more particularly
described as follows:
BEING a 0. 0455 acre ( 1986. 21 square feet) tract
of land, more or less, out of and a part of Lots
4 and 5 , Block 24, Jarrette Addition, Beaumont,
Jefferson County , Texas as recorded in Volume 3 ,
Page 175 of the Map Records of Jefferson County,
Texas, and being half of an alley 12 feet in
width along south lines of said Lots 4 and 5 ,
closed by City of Beaumont Ordinance Number
83-80, and being located in the Noah Tevis
League, Abstract 52.
BEGINNING at an iron rod found for the inter-
section of the southerly right of way line of
Phelan Boulevard and the west line of Lot 5 of
said Jarrette Addition, said iron rod also being
at the intersection of the east line of Lot 1 of
Calder Court Addition and the southerly right of
way line of Phelan Boulevard;
THENCE south 0'54' 14" east along the west line
of said Lot 5 of Jarrette Addition and east line
of said Lot 1 of Calder Court Addition passing
the southwest corner of said Lot 5 of Jarrette
Addition at a distance of 6 .50 feet and
continuing for a total distance of 12. 50 feet to
the centerline of said closed alley ;
THENCE north 88°14' 44" east along the centerline
of said closed alley a distance of 61. 13 feet to
a point for corner;
THENCE north 1 051' 16" west along the projection
of the east line of Lot 4 of said Jarrette
Addition and passing the southeast corner of
said Lot 4 at a distance of 6 .00 feet and
continuing along the east line of said Lot 4 for
Exhibit "A"

a total distance of 52. 32 feet to an iron rod
for intersection of the east line of said Lot 4
and the southerly right of way line of Phelan
Boulevard;
THENCE south 58'26' 38" west along the southerly
right of way line of Phelan Boulevard a distance
of 28.78 feet to an iron rod for the intersec-
tion of the southerly right of way line of Phelan
Boulevard and the common east line of Lot 4 and
west line of Lot 5 of said Jarrette Addition.
THENCE south 52053129" west along the southerly
right of way line of Phelan Boulevard a distance
of 44. 11 feet to the PLACE OF BEGINNING and
containing in area 0. 0455 acres ( 1986. 21 square
feet) of land, more or less.
This conveyance is expressly subject to all covenants,
restrictions, and easements of record affecting said property ,
if any.
TO HAVE AND TO HOLD the Property, together with all and
singular the rights and appurtenances thereto in any wise
belonging unto the said Gilson Viator and Lucille West, their
heirs, successors, and assigns forever, and GRANTOR does hereby
bind itself and its heirs, successors, and assigns, to warrant
and forever defend all and singular the Property unto GRANTEE
and their heirs, successors, and assigns, against every person
whomsoever lawfully claiming or to claim the same or any part
thereof , by , through or under, but not otherwise and subject to
all easements and reservations of minerals of record.
Except, however, that GRANTOR herein reserves, and it is
expressly agreed that it should have for itself , its successors
and assigns the option to repurchase all or any portion of the
above described property for right of way purposes within ten
( 10) years from the date of execution of this deed at a price of
TWO AND NO/100 DOLLARS ($2. 00) per square foot.
