BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT :
THAT the City Manager be, and he is hereby , authorized to execute
amendments to the labor contracts with the Beaumont Police Officers
Association and the International Association of Fire Fighters,
Local 399, establishing a pilot health program for retirees and
agreements with same to provide for funding for the pilot health
program for retirees, substantially in the form attached hereto as
Exhibits "A" , "B" , "C" , and "D" .

AGREEMENT
THE STATE OF TEXAS
COUNTY OF JEFFERSON §
This agreement is entered into by and between the City of
Beaumont, a municipal corporation domiciled in the State of Texas,
herein after referred to as the "Empoyer, " and the Beaumont Police
Officers Association, herein after referred to as the "Union. "
NOW, THEREFORE, the parties mutually agree as follows:

1 .
Article XIX of the labor agreement heretofore entered into
by Employer and Union is hereby amended to read as follows:
Effective April 1 , 1984, the monthly rates paid each grade
shall be as follows:

Rates established herein represent an increase in wages of
2% above the rates in effect March 31, 1984 in lieu of the 3% wage
increase heretofore negotiated because City and Union have reached
an agreement to fund a pilot health insurance program for retired
and disabled employees with the City contributing 1% of fire
fighter wages effective March 31, 1984 into the program.

Article XXII, Section 5 of the labor agreement between
Employer and Union is hereby amended to read as follows:
Article XXII. Section 5 .
The Union and the Employer agree to review prior to, and
implement on April 1 , 1984, the health insurance program for
employes retiring or becoming disabled ( if eligible for a
disability pension under the Texas Municipal Retirement System)
after April 1 , 1984. The retired or disabled employee shall
contribute monthly a sum equal to the group insurance rate
established by the employer for its employees. City shall
contribute 1 . 0518% of police officers wages as of March 31, 1984
into the program. Should the pilot health insurance program
require other monies to sustain the fund, the city agrees to
contribute a maximum of $10,000 into the program over the 18-month

period, April 1 , 1984 through September 30, 1985. The Union
agrees that the total compensation received by its members shall
include the amount contributed to the pilot health insurance
program.
IN WITNESS WHEREOF, the Beaumont Police Officers
Association has caused this agreement to be executed by its
president by order of its membership, and the City of Beaumont has
caused this agreement to be signed by the city manager on the
day of , 1984.

AGREEMENT

COUNTY OF JEFFERSON
WHEREAS, the City of Beaumont (herein "City" ) and the
Beaumont Police Officers Association ( herein "Union" ) , have by
their labor contract agreed to implement a health insurance
program on April 1 , 1984 for those employees who retire or become
disabled on or after such date.
NOW , THEREFORE, the parties mutually agree as follows:

1 .
Pruco Life/Prudential will provide medical coverage for
policemen retiring or becoming disabled after April 1 , 1984.
The term of this agreement shall be April 1 , 1984 to March 31,
1985. The pilot program described herein shall be an 18-month
program commencing April 1 , 1984.
2.
Retired or disabled employees desiring to participate
shall contribute $80. 00 per month for such employee, $150. 00 per
month for such employee and one dependent, and $200. 00 per month
for family coverage. These monthly amounts shall be paid into the
trust fund established herein.

In addition to the monies paid into the trust fund by the
retired or disabled employee, the City will contribute an amount
equal to 1. 0518 percent of police wages as of March 31, 1984 into
the trust fund. Should the trust fund require other monies to
sustain the insurance program, the City agrees to contribute a
maximum of $10,000 into the fund during the eighteen ( 18) month
pilot program. Payment shall be made on a monthly basis.

For the term of the pilot program herein described,
premiums shall be paid to Pruco Life/Prudential out of the trust
fund as follows:

month or ( number of
participants) x $600.
The premium herein established shall provide medical
insurance for the first plan year ( April 1 , 1984 to March 31,
1985) .
5.
City will be responsible for payment of the premiums out
of the trust fund and shall hold the trust fund at interest
separate and discrete from other City monies. City will provide a
certified audit of the fund to Union at the time the annual City
audit is completed.
6.
Retired or disabled policemen may participate in the
program if they are eligible for retirement or disability benefits

under the Texas Municipal Retirement System. Coverage provided by
the program will be substantially the same as the coverage
provided to active policemen.
7.
Retired or disabled employees participating in the plan
are required to enroll for both Part A, Hospital Insurance, and
Part B , Supplementary Medical Insurance, under the U. S.
Government Medicare Program. Failure to become a subscriber as
required herein will result in the participant' s exclusion from
the program herein established.

WHEREAS, the City of Beaumont ( herein "City" ) and the
International Association of Fire Fighters, Local 399 (herein
"Union" ) , desire to amend the labor contract heretofore executed
by the parties on the day of _ 1984 to
amend paragraphs XXIII and XXIV to reflect the changes in the
labor agreement necessary to institute a pilot health program for
retired and disabled employees.
NOW , THEREFORE, the parties mutually agree as follows:

Rates established herein represent an increase in wages of
20 above the rates in effect March 31, 1984 in lieu of the 3% wage
increase heretofore negotiated because City and Union have reached
an agreement to fund a pilot health insurance program for retired
and disabled employees with the City contributing to of fire
fighters wages effective March 31 , 1984 into the program.

Article XXIV of the labor agreement between City and Union
is hereby amended to read as follows:
Effective November 1 , 1983, the Employer shall provide
life insurance protection as follows:
Grade I $15,000
Grade II 15,000
Grade III 15,000
Grade IV 20,000
Grade V 20,000
Grade VI 20,000
Effective October 1, 1984, the Employer shall provide all
employees with $20,000 life insurance coverage.
The Employer agrees to pay the cost of each employee's and
each employee' s dependent' s group health insurance. Group health

insurance benefits shall not be less than those in effect on
February 1 , 1980. The minimum benefits may be modified by the
Employer with the prior consent of the Union, which consent shall
not be unreasonably denied or delayed.
The Employer will provide a dental insurance plan for
employees and their dependents. The first $15.50 of monthly
premium for this plan will be paid by the Employer.
The Union and the Employer agree to review prior to, and
implement on April 1 , 1984, a health insurance program for
employees retiring or becoming disabled ( if eligible for dis-
ability pension is determined by the Firemen's Pension Fund)
after April 1 , 1984. The retired or disabled employee shall
contribute a sum equal to the group insurance rate established by
the employer for its employees. The City shall contribute 1. 1% of
fire fighters wages as of March 31, 1984 into the program. Should
the pilot health insurance program require other monies to sustain
the fund, the City agrees to contribute a maximum of $10 ,000 into
the program over the 18-month period, April 1 , 1984 through
September 30, 1985. The Union agrees that the total compensation
received by its members shall include the amount contributed by
City to the pilot health insurance program.
IN WITNESS WHEREOF , International Association of Fire
Fighters, Local 399, has caused this agreement to be executed by
its president by order of its membership and the City of Beaumont

and Retirement Fund of Beaumont, Texas. Coverage provided by the
program will be substantially the same as that provided to active
fire fighters.
7 .
Retired or disabled employees participating in the plan
are required to enroll for both Part A, Hospital Insurance, and
Part B , Supplementary Medical Insurance, under the U. S.
Government Medicare Program. Failure to become a subscriber as
required herein will result in the participant' s exclusion from
the program herein established.
