BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to enter
into a contract with Brackenridge Hospital of Austin, Texas ,
in the form attached hereto as Exhibit "A" , for training and
instruction in the administration of a wellness program for
the City of Beaumont.

CONTRACT FOR FRANCHISE
- OF CHOICES PROGRAM
Whereas, there is a need by Beaumont Health Department to obtain and market
health education and motivation in the area of wellness, and,
Whereas, Brackenridge Hospital provides a comprehensive wellness program in
the form of the Choices Program,
Therefore; this agreement is made between Brackenridge Hospital/City of
Austin, a home rule municipal corporation of Travis County, Texas, herein-
after referred to as "Brackenridge" and the Beaumont Health Department;
hereinafter referred to as "Licensee" , each acting by and through its duly
authorized officials.
Brackenridge agrees to franchise a complete wellness course, "Choices",
with the necessary support services according to the following terms:
1 . License. The licensee shall have the exclusive rights to use and
market the "Choices" program to final consumers in the Beaumont metro-
politan area designated by the licensee and Brackenridge in Exhibit A,
attached hereto and herein incorporated by reference for all purposes.
For the purposes of this agreement, "final consumers" shall mean the
licensee's employees, community groups, employees at work sites , and/or
individuals which participate in the learning experience conducted
directly by the licensee. The licensee acquires the right to use the
instructional materials for the "Choices" class, to receive periodic
revisions in the lecture and student materials, to purchase sets of

student materials, and to 'acquire training and other supportive services
for the implementation of the program. The licensee also will have the "
right of first refusal in its market area for advanced courses , health
information campaign, and other wellness services under development by
Brackenridge Hospital . Advanced courses may be purchased separately at
the discretion of the licensee.
2. License Period: The license period shall be one year, with $2,000
license fee. The licensee has an option to renew for additional periods ,
with a $1,500 per year fee for subsequent periods.
3. Instructor Training: The licensee is required to register all
prospective "Choices" instructors in a two-day traininq session con-
ducted by Brackenridge. The fee for training shall be $400/day for
the two-day session. Licensee shall be allowed to register up to ten
(10) prospective instuctors in a training session. All traveling
expenses shall be the responsibility of the licensee.
4. Consultation: Consultation on how to set up and market the "Choices"
program will be provided at no charge at the same time as the two-day
instructor training session. Additional consultation will be billed at
the standard rate of $50/hour. All traveling expenses related to any
additional consultation shall be borne by the licensee.
5. Instructor Materials: The licensee may purchase copies of each
instructor' s notebook for $10 per copy. The notebook includes the
prepared lectures for the "Choices" class, a section of recommendations

on presentation style, and answers to the questions most commonly
asked in the "Choices" class.
6. Student Materials: The licensee may ourchase from Brackenridge
sets of student materials for the "Choices" class. The cost is $5 per
set for each student. The set includes: Choices Self-Assessment,
Choices Handbook, Registration Card, Nutrition Worksheet, Plan of
Action, 3-Month Follow-up Questionnaire, and 12-Month Follow-up
Questionnaire.
7. Printing of Materials: Brackenridge Hosptial will handle the
printing of all student materials and will ship them to the Beaumont
Health Department at the lowest available rate. The licensee will
pay shipping charges. The Choices Handbook will be printed with the
Beaumont Health Department' s name on the cover to the satisfaction of
the licensee and Brackenridge. The other items will have no sponsoring j
name on the publicatons. A few items must be copied by the licensee
for each class, including discussion guides for the breakout groups
and class evaluation questionnaires. The licensee also will pay for
the printing of postage-paid return envelopes and cover letters for
the follow-up questionnaires.
8. Other Instructional Costs: The licensee will need to purchase
audiovisual equipment used in the class , including: 16mm film projector,
slide projector, tape player with sync. Other additional costs for
instructional materials include four films, a collapsible easel , display
cards to accompany the nutition lecture, tennis balls used in a relaxa-
tion exercise, and a collapsible dolly for moving equipment.

9. Co, ,right: Brackenridge retains copyright privilege for all
original material . .
10. Reproduction: Permission for reproduction of the "Choices"
lectures and student materials for any purpose must be obtained in
writing from Brackenridge.
11. Other Available Services: Additional services and publications
are available to the licensee at an additional cost. These include:
Promotional brochures about the "Choices" program
Quarterly Choices newsletter
Computer program for recording registration cards
Computer program for compiling end-of-the-year report
Computer program for compiling follow-up questionnaire results
Advanced wellness classes developed by Brackenridge

Work site wellness information campaigns
HealthCheck--A Screening Program
The terms of theis agreement shall be effective April 1 , 1984-March 31, 1985.
