BE IT RESOLVED BY THE CITY COUNCIL
OF' THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby , authorized to execute a
license agreement, on behalf of the City of Beaumont, with Don and
Doris Charlesworth for the use of that portion of real property
described in a license agreement attached hereto as Exhibit "A" for
all purposes.

LICENSE AGREEMENT
This agreement, made this day of
19 by and between the City of Beaumont, a municipal corporation
in Beaumont, Jefferson County, Texas, hereinafter called the
"Licensor" and Don and Doris Charlesworth, hereinafter called the
"Licensee" .
WHEREAS, the Licensor is the owner of the real property
described in Exhibit "A" attached hereto and made a part hereof ,
situated within the corporate limits of Beaumont, Jefferson
County, Texas; and,
WHEREAS, the Licensee desires to exercise certain rights
and privileges upon the above-described property;
NOW , THEREFORE, it is agreed as follows: Licensor hereby
grants to Licensee a license to occupy and use subject to all of
the terms and conditions hereof, that portion of the above-
described property on which Licensee has a structure encroaching.
The premises upon which Licensee' s building encroaches
may be occupied and used by Licensee solely in connection with the
existing building and for incidental purposes related thereto
during the period beginning on this date and continuing until this
agreement is terminated as hereinafter provided.
In consideration for this agreement, the Licensee shall
pay to Licensor the sum of Ten Dollars ( $10.00) and other good and
valuable consideration.
This license is personal to the Licensee. It is
non-assignable and any attempt to assign this license will
terminate the license privileges granted to Licensee hereunder.
This agreement is terminable by either party by giving written
notice to the other specifying the date of termination. Such
notice shall be given not less than thirty ( 30) days prior to the
termination date therein specified.
EXHIBIT "A"
Being a 50 foot strip of land out ' of the Gulf Street right-of-way
and 140 , 40 foot strip of land out of the Oak Street right-of-way,
said strip of land being described as follows :
Commencing at an iron rod at the northwest corner of Lot 8 of
Block 33 of the McFaddin Heights Addition to the City of Beaumont
as recorded in Volume 6 , Page 196 , of the Map Records of
Jefferson County, Texas .
Thence on a bearing of East with the north line of said Lot 8 a
distance of 150 .00 feet to an "X" in a concrete footing for a
chain link fence post in the west line of Gulf Street , a 60 .00
foot wide City of Beaumont right-of-way;
Thence on a bearing of South with the west line of Gulf Street a
distance of 50 . 00 feet to the Point of Beginning of the herein
described strip of land ;
Thence continuing on a bearing of South with the west line of
Gulf Street a distance of 49. 05 feet to a point for corner in the
north line of Live Oak Street , a 60 .00 foot wide City of Beaumont
right-of-way, said point also being the southeast corner of Lot 7
of Block 33 of McFaddin Heights Addition ;
Thence on a bearing of West with the north line of Live Oak
Street and the south line of said Lot 7 a distance of 139. 76 feet
to a point for corner ;
Thence on a bearing of South a distance of 0 . 59 feet to a point
for corner ;
Thence South 89 degrees 51 minutes 12 seconds East a distance of
140 .40 feet to a point for corner ;
Thence North 00 degrees 17 minutes 51 seconds West a distance of
50 .00 feet to a point for corner ;
Thence on a bearing of West a distance of 0 . 38 feet to the Point
of Beginning ;
The herein described strip containing 132 . 94 square feet of land .

EXHIBIT "A"
Any notice to Licensee hereunder shall be sufficient if
mailed to Thad Heartfield, attorney for Licensee, at 605 San
Jacinto Building, Beaumont, Texas 77701 .
IN WITNESS, WHEREOF , the parties hereto have executed
this agreement on the day and year first above written.
