R E S O L U T I O N
WHEREAS, the City Council of the City of Beaumont deems
it necessary that the FM 364 (Major Drive) and Calder intersection
in the City of Beaumont, Jefferson County, Texas be located,
constructed, widened, extended and maintained; and,
WHEREAS, said City Council has found that a public
necessity exists requiring the location, construction, widening,
extension and maintenance, of said street on the hereinafter
described property; and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction, widening.,
extension and maintenance of said street, and has found and
determined that said interests in and to the hereinafter described
land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the hereinafter described land and has been unable to
agree with such owners of such property as to the fair market
value thereof and damages, if any ,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY OF BEAUMONT:
THAT Kenneth Wall, City Attorney , be and he is hereby authorized
and directed to file or cause to be filed against all owners of
the following parcel of land, and all claimants of any interest
therein, proceedings in eminent domain to acquire fee title for
said purposes, in and to the said parcel of land described in
Exhibits "A" attached hereto and made a part hereof, the parcel of
land being situated in Beaumont, Jefferson County, Texas:
Parcel 154: A 22,882 square foot tract of land
out of Tract 147, City Plat SP-2, C . Williams
League, and H. Williams Survey , Beaumont,
Jefferson County, Texas.

Being 0.5253 of one acre of land, more or less, out of and a part of that
certain 3.2172 acre tract of land lying and being in the C. Williars
Survey, Abstract No. 59 and the H. Williams Sr. Survey, Abstract No. 56,
Jefferson County, Texas, said 3.2172 acre tract of land-being the same land
described in a deed from George A. DisYman, Jr. to M. A. Phelan, Trustee
dated June 10, 1976, recorded in Volume 1942, Paa_e 254, Deed Records of
Jefferson County, Texas, said 0.5253 of one acre of land, more or less,
being more particularly described by metes and bounds as follows:
CCrg LACING at the northeast corner of said 3.2172 acre tract, thence
S 890 41' 28" W alone the north line of said 3.2172 acre tract, a distance
of 264.10 feet to a point for corner on the proposed east right of way
line of FM Highvray 364, said point being the POINT CF BEGINNING of the
tract herein conveyed:
THENCE South 00 7' 27" East along the proposed east right of way line of
FM Highway 364, a distance of 147.70 feet to a point for corner;
THENCE South 20 27' 22" East continuing along the proposed east right
of way line of FM Highway 364, a distance of 229.34 feet to a point for
corner;
THENCE South 370 49' 34" East continuing along the proposed east right
of way line of FM! Highway 364, a distance of 67.64 feet to a point for
corner on the proposed north right of way line of Calder Avenue;
THENCE South 750 12' 20" East along the proposed north right of way line
of Calder Avenue, a distance of 221.24 feet to a point for corner in the
east line of said 3.2172 acre tract,
THENCE South 00 10' 8" East along the east line of said 3.2172 acre tract,
a distance of 25.36 feet to a point for corner in the existing north
right of way line of Calder Avenue;
THENCE North 750 12' 20" West along the existing north right of way line
of Calder Avenue, a distance of 243.20 feet to a point for corner;
THENCE South 890 53' 40" West along the existing north right of way line
of Calder Avenue, a distance of 60.00 feet to a point for corner on the
existing east right of way line of FF. Highway 36A;
THENCE North 00 7' 27" West along the existing east right of way line of
FM Highway 364, a distance of 449.96 feet to a point for corner on the
north line of said 3,2172 acre tract;
THENCE North 890 41' 34" East alone the north line of said 3.2172 acre
tract, a distance of 30.50 feet to the POINT OF BEGINNING and containing
0.5253 of me acre of land, more or, less.

GC-MD, GENERAL COMMERCIAL MULTIPLE-FAMILY
DWELLING DISTRICT
GENERAL PURPOSE AND DESCRIPTION: The mixed GC-MD, General Com-
mercial Multiple-Family Dwelling District, is intended for the
conduct of community-wide personal and business services, speciality
shops, general highway commercial uses, shopping centers, and multi-
family residential development. The need for community-wide
accessibility dictates that this district be located ideally at
the intersection of two or more streets, along frontage roads
adjacent to the interstate, or along selected major streets which
have been designated for strip commercial development. Minimum
lot width, depth, area, and yard requirements, buffer strips, and
landscaping bonus provisions have been established to reduce or
modify the harmful impact and negative consequences associated
with typical strip commercial development. Multi-family develop-
ment in this district is permitted in order to serve as a buffer
or transition between commercial and medium density residential
development.
RANGE OF USES: General merchandise stores, food stores, new and
used car dealers, gasoline service stations, eating establishments,
drug, liquor, sporting goods and stationery stores, banks, hotels,
washaterias, beauty and barber shops, advertising signs, general
automotive repair shops, doctors and dentists offices.
