HomeMy WebLinkAboutRES 82-238 R E S 0 L U T 1 0 N WHEREAS., the City Council of the City of Beaumont deems it necessary that the Phelan Boulevard Extension Project in the City of Beaumont, Jefferson County, Texas be located, constructed, widened, extended and maintained; and, WTiEREAS, said City Council has found that a public necessity exists requiring the location, construction, widening, extension and maintenance, of said street on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction, widening, extension and maintenance of said street, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, agreements have been negotiated for the purchase of three parcels of property needed for the Phelan Boulevard Extension Project being more fully described in Exhibits "All through IICII attached hereto for their respective appraised values; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the property more fully described in Exhibits I'D" and "Ell attached hereto and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any; NOW , THEREFORE, BE IT' RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the purchase of the following parcels are hereby authorized: Parcel 3 : 1 ,450 square feet out of City Tax Tract 86, Plat SP-6, C. Williams League Owners : Sam Parigi, Jr. Mal4k J. Kubala R. 1'. Fertitia, Jr. Ed Culotta Rost, Ann Fertitta Vali-l.e : $4,350. 0b C - 2 9- P� Parcel 21: 6,570 square feet out of City Tax Tract 216, Plat SP-6 C . Williams League Owner: Dr. James L. Massey Value : $18,538- 00 Parcel 153: 8,180 square feet out of City Tax Tracts 150, 171, and 171-A, Plat SP-6, C . Williams League Owner: Joe E. Smith Value : $23,492. 00 BE IT FURTHER RESOLVED by the City of Beaumont that Kenneth Wall, City Attorney, be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcels of land, and all claimants of any interest therein, proceedings in eminent domain to acquire fee title for said purposes, in and to the said parcels of land described in Exhibits I'D" and "Ell attached hereto and made a part hereof, each parcel of land situated in Beaumont, Jefferson County, Texas: Parcel No. 5-B: 2,670 square foot tract of land out of County Tax Tract 335, C.
