WHEREAS., the City Council of the City of Beaumont deems
it necessary that the Phelan Boulevard Extension Project in the
City of Beaumont, Jefferson County, Texas be located, constructed,
widened, extended and maintained; and,
WTiEREAS, said City Council has found that a public
necessity exists requiring the location, construction, widening,
extension and maintenance, of said street on the hereinafter
described property; and,
WHEREAS, the City Council deems it necessary to acquire
the hereinafter described interests in and to the hereinafter
described property for said location, construction, widening,
extension and maintenance of said street, and has found and
determined that said interests in and to the hereinafter described
land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, agreements have been negotiated for the
purchase of three parcels of property needed for the Phelan
Boulevard Extension Project being more fully described in Exhibits
"All through IICII attached hereto for their respective appraised
values; and,
WHEREAS, the City of Beaumont, through its duly
authorized representatives, has negotiated in good faith with the
owners of the property more fully described in Exhibits I'D" and
"Ell attached hereto and has been unable to agree with such owners
of such property as to the fair market value thereof and damages,
if any;
NOW , THEREFORE, BE IT' RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the purchase of the following parcels are hereby authorized:

Kenneth Wall, City Attorney, be and he is hereby authorized and
directed to file or cause to be filed against all owners of the
following parcels of land, and all claimants of any interest
therein, proceedings in eminent domain to acquire fee title for
said purposes, in and to the said parcels of land described in
Exhibits I'D" and "Ell attached hereto and made a part hereof, each
parcel of land situated in Beaumont, Jefferson County, Texas:

BEING a 0.168 acre tract of land in the C. Williams Survey, Abstract No .
59 in Beaumont, Jefferson County, Texas and being out of that certain
tract of land described in deed from Anthony C. Parigi , Jr . to Sam C.
Parigi , Jr . dated December 28, 1979 and recorded in Vol . 2203 Page 8 of
the Deed Records of Jefferson County,Texas and said 0. 168 acre tract of
land being more particularly described by metes and bounds as follows :
BEGINNING at a 3/4 inch iron pipe found at the intersection of the East
right-of-way line of Shakespeare Drive and the South line of that certain
50 foot right-of-way described in deed from the Missouri Pacific Railroad
Company to the City of Beaumont dated December 31, 1960 and recorded
under the County Clerk' s File No. 597774 in the Deed Records of Jefferson
County, Texas locating the Northwest corner of said Sam C. Parigi , Jr .
tract of land and the Northwest corner of that certain 20 foot wide strip
of land described in deed from Anthony C. Parigi to the City of Beaumont
dated August 31, 1973 and recorded in Vol . 1801 Page 453 of the Deed
Records of Jefferson County, Texas and locating the Northwest corner of
the tract of land herein described; and also locating the beginning of a
nontangent curve concave to the North having a radius of 5754.6 feet,
having a central angle of 2 degrees 54 minutes 20 seconds and whose chord
bears North 83 degrees 22 minutes 07 seconds East ;
THENCE in a Easterly direction along the South side of said 50 foot
right-of-way and along the arc of said curve an arc distance of 291 .82
feet to the West line of an 80 foot wide drainage easement and to the
West line of a 40 foot wide tract of land described in deed from Fred C.
Hodge to Jefferson County Drainage District No. 6 by deed dated February
25, 1965 and recorded in Vol . 1418 Page 68 of the Deed Records of
Jefferson County, Texas;
THENCE South 0 degrees 51 minutes 24 seconds East along the West line of
said drainage easement and the East line of said Sam C. Parigi , Jr . tract
of land a distance of. 25.20 feet to a 5/8 inch iron rod placed in the
proposed South right-of-way line of Phelan Boulevard (105 foot
right-of-way) and the beginning of a nontangent curve concave to the
North and concentric to the South line of said 50 foot right-of-way
conveyed by the Missouri Pacific Railroad to the City of Beaumont, having
a radius of 5779.6 feet, having a central angle of 2 degrees 53 minutes
39 seconds and whose chord. bears South 83 degrees 23 minutes 40 seconds
West ;
THENCE in a Westerly direction along the proposed South right-of-way line
of said Phelan Boulevard and the arc of said curve an arc distance of
291.94 feet to a 5/8 inch iron rod placed in the East line of Shakespeare
