WHEREAS, by resolution of the City Council (the
"Governing Body" ) , the City of Beaumont., Texas ' the "City") ,
authorized arid approved the creation of the Beaumont Industrial
Development Corporation (the "Corporation") as a nonprofit
industrial development corporation under the provisions of the
Development Corporation Act of 1979, Article 5190. 6, Vernon's
Annotated Texas Civil Statutes., as amended (the "Act") ; and,
WHEREAS, the Corporation is authorized by the Act to
issue bonds on behalf of the City for the purpose of paying all or
a part of the costs of a "project" as defined in the Act, and to
lease or sell the project or to loan the proceeds of the bonds to
finance all or part of the costs of a project; and.,
WHEREAS, the definition of "project" in the Act includes
the land, buildings, equipment, facilities and improvements (one or
more) found by the Board of Directors of the Corporation to be
required or suitable for the promotion of commercial development
and expansion and in furtherance of the public purposes of the Act,
or for use by commercial enterprises, all as defined in the rules
of the Texas Industrial Commission (the "Commission") , irrespective
of whether in existence or required to be acquired or constructed
thereafter, if such project is located in blighted or economically
depressed areas; and'.
WHEREAS, as used in the Act, the term "blighted or
economically depressed areas" means those areas and areas
immediately adjacent thereto within a City which by reason of the
presence of a substantial number of substandard, slum.,
deteriorated, or deteriorating structures, or which suffer from a
high relative rate of unemployment, or which have been designated
and included in a tax incremental district created under Chapter
695, Acts of the 66th Legislature, Regular Session, 1979 (Article
10664, Vernon's Texas Civil Statutes) , or any combination of the

foregoing, the City finds and determines, after a hearing,
substantially impair or arrest the sound growth of the City, or
constitute an economic or social liability and are a menace to the
public health, safety or welfare in their present condition and
use; and,
WHEREAS, the Act requires that a notice of a hearing at
which the City considers establishment of an economically depressed
or blighted area shall be posted at the City hall prior to such
hearing; and,
WHEREAS, Section 107. 1 (b) (9) of the rules ( the "Rules")
of the Texas Industrial Commission (the "Commission") for
industrial projects sets out special rules for approval of
commercial projects in blighted or economically depressed areas;
and,
WHEREAS, the governing body of the City desires to
authorize the financing of certain projects for commercial uses as
provided in the Act and the Rules by establishing one or more
eligible blighted areas;
N0W , THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
Section 1.
That a public hearing concerning designation of the area
outlined in red on the attached map of a portion of the City as an
eligible blighted areas, as defined in the Act and the Rules, shall
be held in the City Council Chambers at the City Hall on May 11,
1932, at 1 :00 p.m. Such public hearing shall be held pursuant to
the provisions of the Act and Chapter 107 of the Rules for the
purposes of establishing one or more eligible blighted areas.
Section 2.
The Mayor of the City is hereby authorized to notify the
Commission of the intention of the City to hold such public hearing
by providing a certified copy of this resolution to the Executive

Director of the Commission not less than fifteen (15) days prior to
the date established for the public hearing in Section 1 of this
resolution.
Section 3.
Notice of the public hearing shall be published once a
week for two consecutive weeks in a newspaper of general
circulation in the City and notice of the public hearing shall be
posted at the City Hall at least fifteen ( 15) days prior to the
date of the public hearing. The notice as published and posted
shall contain a description of the area or areas to be designated
as an eligible blighted area (as shown on Exhibit "A" hereto) and
shall contain the date, time and location of the public hearing.
Section 4.
The notice as published and posted shall also include the
information shown on Exhibit "B" to this resolution with respect to
the reasons for the designation by the City of the eligible
blighted area, the description of the overall objectives of the
City for redevelopment and recovery of the eligible blighted area,
a description of the type of projects for commercial uses desired
and authorized by the City to enhance its redevelopment efforts in
the eligible blighted area and a description of any exclusions or
limitations by type or amount of commercial uses which the City
would consider detrimental to its efforts to redevelop the eligible
blighted area and a description of proposed public improvements, if
any, to be made in the eligible blighted area, including the
estimated commencement date, the approximate schedule and the
sources of funds for such public improvements.
Section 5.
This resolution is adopted for the purposes of satisfying
the conditions and requirements of the Act and the Rules, and for
the benefit of the Corporation, the City, the Commission, the
residents of the unit and all other interested persons.

Section 6.
The Governing Body has considered evidence of the posting
of notice of this meeting and officially finds, determines, recites
and declares that a sufficient written notice of the date, hour and
place of this meeting and of the subject of this resolution was
posted on the bulletin board at a place convenient to the public in
the City Hall of the City , for at least seventy-two (72) hours
preceding the scheduled time of such meeting; such place of posting
was readily accessible to the general public at all times from such
time of posting until the scheduled time of such meeting; and such
meeting was open to the public as required by law at all times
during which this resolution and the subject matter thereof were
discussed, considered and formally acted upon, all as required by
the Open Meetings Law, Article 6252-17, Vernon's Annotated Texas
Civil Statutes, as amended.

The boundaries of the proposed "Eligible Blighted Area"
are as follows :
Starting at the intersection of the center lines
of North and Forrest Streets, south along the
centerline of Forrest Street to the Southern
Pacific Railroad right-of-way; then proceeding
south along the extension of the center line of
Forrest Street to its intersection with the
extension of the centerline of Archie Street;
then proceeding generally southeast along the
centerline of Archie Street to its
intersection with the centerline of Blanchette
Street; then generally northeasst along the
centerline of Blanchette Street to its
intersection witht he centerline of Main Street
to its intersection with the centerline of the
Kansas City Southern Railroad right-of-way; then
generally northeast to the intersection of the
centerline of the Kansas City Southern
right-of-way with the Beaumont City Limits
(Neches River) ; then generally northwest along
the City Limits (along the Neches River and into
Brakes Bayou) to the intersection of the City
Limits and the extension of the centerline of
North Street; then west along the extended
centerline of North Street to the centerline of
North Street; then west to the starting point,
the intersection of the centerlines of North and
Forrest Streets.

EXHIBIT "B"
A portion of the Central Business District should be
designated an eligible blighted area based upon an analysis of
physical, economic and demographic data concerning the downtown
area and the immediately surrounding neighborhoods. The proposed
eligible blighted area contains portions of Census Tracts 10, 15,
16, and 18. The population of the subject area can be
characterized as predominantly minority and low-income. The
structural condition of housing in the subject area is generally
very poor, and the area is losing population and housing stock at a
rapid rate.
Visual inspection of the subject area and an inspection
of detailed land use survey maps indicate that there is a high
incidence of vacancy and deterioration of commercial structures.
There is a high incidence of under-utilization of land and
structures for marginal businesses. Most of the new construction
in recent years has been undertaken by governmental entities and
utility companies. New private-sector construction has been
virtually absent. Between 1972 and 1977, the total number of
commercial firms located in Census Tract 16, which contains most of
the Central Business District, declined from 1471 to 3142.
Designation of an eligible blighted area in the subject
area will assist in implementation of the following objectives to
the physical and economic recovery and redevelopment of the area:
I . Increased convention and tourism related employment
Opportunities;
2. Increased private sector jobs available to low-
income, unemployed, and unskilled residents in the
distressed neighborhoods surrounding the Central
Business District;
3• Capitalize upon Beaumont's position as a regional
center of commerce, government, education, and
finance;

4. Protect the taxpayers ' investment in community
facilities and infra-structure (streets, utilities,
etc. ) in the downtown area;
5. Aid the downtown area in making the transition from
its previous economic function as a retail trade
center to a center of entertainment, tourism,
professional offices, government and finance;
6. Protect the City's tax base by preventing the
collapse of downtown property values that may result
from failure to reverse physical and economic decline
of the area;
7. Encourage rehabilitation and adaptive reuse of
under-utilized and deteriorated structures, vacant
buildings, and historically or architecurally
significant structures;
8. Encourage construction of new mid-rise and high-rise
buildings to make more efficient use of downtown
land resources;
9. Encourage new retail and service operations to meet
the needs of the "daytime population" of downtown
office workers;
10. Use public-sector financial incentives and capital
improvements to encourage private-sector investments
in the downtown area;
The following constitute the general types of commercial
projects needed to meet the City' s objectives for revitalization of
the proposed eligible blighted area: Hotels, restaurants, regional
or national corporate headquarters, professional offices, retail
and service establish-ments, wholesale trade and distribution,
printing, ship's channelers, automobile sales, department stores,
and banks and savings and loans. Other types of projects not on
the list will be encouraged if they support the City' s
revitalization objectives.
