T�� ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 97-40 BY ADDING THE LANGUAGE "AND A REINVESTMENT ZONE" TO SECTION 5; AND THAT THE ZONE BE ENLARGED BY EXTENDING IT 9,100 FEET SOUTHWEST OF SMITH ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL. WHEREAS, the Department of Commerce has requested that the City amend Section 5 of Ordinance 97-40 passed by the City Council August 26, 1997 by adding "and a reinvestment zone" after "enterprise zone"; and WHEREAS, the County Judge of Jefferson County, Texas recommends extending the zone 9,100 feet southwest of Smith Road to take in the entire Goodyear complex; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Section 5 of Ordinance 97-40 of the City of Beaumont be amended to read as follows: That the area described in this ordinance is designated as an enterprise zone and a reinvestment zone, subject to the approval of the Texas Department of Commerce; and BE IT FURTHER ORDAINED that the Enterprise Zone nominated by Ordinance 97- 40 of the City of Beaumont be enlarged 5,100 feet by extending it 9,100 feet southwest of Smith Road as shown in Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only.
