HomeMy WebLinkAboutORD 97-57 ORDINANCE NO. ` 1'S ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND REMOVAL; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 995 Avenue B 15. 2950 Hebert 2. 2300 Avenue D 16. 2560 Hegele 3. 1661 Blanchette (Garage Apartment) 17. 285 Iowa (Barn) 4. 1425 Burt 18. 500 Jackson 5. 1545 Burt 19. 2235-41 Laurel 6. 875 Cartwright 20. 2250 Leight 7. 4490 Ector 21. 1614 Port 8. 4490 Ector(Garage) 22. 5260 Roberts Rd. 9. 563 Euclid 23. 325 E. Simmons 10. 565 Euclid 24. 2655 Sycamore 11. 1305 Evalon 25. 865 Villiva Lane 12. 275 Fletcher 26. 875 Villiva Lane (Sheds) 13. 430 Fletcher 27. 895 Villiva Lane 14. 3608 Glenwood 28. 899 Villiva Lane to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section '10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1. 995 Avenue B 15. 2950 Hebert 2. 2300 Avenue D 16. 2560 Hegele 3. 1661 Blanchette (Garage Apartment) 17. 285 Iowa (Barn) 4. 1425 Burt 18. 500 Jackson 5. 1545 Burt 19. 2235-41 Laurel 6. 875 Cartwright 20. 2250 Leight 7. 4490 Ector 21. 1614 Port 8. 4490 Ector(Garage) 22. 5260 Roberts Rd. 9. 563 Euclid 23. 325 E. Simmons 10. 565 Euclid 24. 2655 Sycamore 11. 1305 Evalon 25. 865 Villiva Lane 12. 275 Fletcher 26. 875 Villiva Lane (Sheds) 13. 430 Fletcher 27. 895 Villiva Lane 14, 3608 Glenwood 28. 899 Villiva Lane Section 3a. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings either demolish, repair or initiate a work program for repair of said structure within thirty (30) days of the effective date of this ordinance: 29. 1150 Delaware 31. 1373-75 Evalon 30. 1150 Delaware (Garage Apartment) Section 3b. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings either demolish, repair or initiate a work program for repair of said structure within sixty (60) days of the effective date of this ordinance: 32. 2020 Broadway Section 4. The City Council hereby finds and declares the following structures to be a public nuisance and authorizes that they be immediately demolished on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the building is situated: 33. 2150 Buchanan 35. 2345 St. Anthony 34. 1257 Evalon Section 5. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were heretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 36. 2221 Avenue E. 46. 610 Pollard 37. 2005 Delaware 47. 630 Pollard 38. 1895 Franklin (Front) 48. 2230 Poplar 39. 1895 Franklin (Garage Apartment) 49. 2376 Sabine Pass Avenue 40. 2350 Grand (Church) 50. 1030 Schwarner 41. 1772 Herring Aly 51. 1040 Schwarner 42. 2196 Leight 52. 1050 Schwarner 43. 180 Manning 53. 1060 Schwarner 44. 1046 Miller 54. 1709 Texas 45. 330 Parkway Drive 55. 856 Trinity Section 6. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 7. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
