HomeMy WebLinkAboutORD 97-37 ORDINANCE NO. - ` ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY ESTABLISHING AN HC-L (HISTORICAL-CULTURAL LANDMARK PRESERVATION DESIGNATION) FOR PROPERTIES LOCATED APPROXIMATELY BETWEEN FIRST, FOURTH AND ELEVENTH STREETS AND BROADWAY AND SMART STREET, PROPERTIES BEING WITHIN THE AVERILL, PALM PLACE, OAKS, PARKDALE AND MCFADDIN SECOND ADDITIONS, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-513 thereof, is hereby amended by establishing an HC-L (Historical-Cultural Landmark Preservation Designation) for property located approximately between First, Fourth and Eleventh Streets and Broadway and Smart Street, properties being within the Averill, Palm Place, Oaks, Parkdale and McFaddin Second Additions, and described as Averill Addition, Blocks 1-2, Lots 1-26, Block 3, Lots 14-26, Block 22, Lots 6, 7, E '/ of 8, 15-28, Blocks 23-24, Lots 1-28, Blocks 25-26, Lots 1-26, Block 27, Lots 14-26, Block 46, Lots 1-10, 14-26, Block 47, Lots 1-26, Block 48, Lots 1-10, Block 49, Lots 8-14, 18-23, 28-30, Palm Place Addition, Block 1, Lots 1-3, Block 2, Lots 1-6, Oaks Addition, Block 1, Tr. 1-4, A, Block 2, Lots 1-12, Blocks 3-6, Lots 1-18, Blocks 1-18, Blocks 7-10, Lots 1-12, Blocks 11-14, Lots 1-18, Blocks 15-18, Lots 1-12, Blocks 19- 20, Lots 1-18, Parkdale Addition, Block 3, Lots 4-9, Blocks 4-9, Lots 1-12, Block 10, Lots 3-8, Block 15, Lots 2-8, Blocks 16-21, Lots 1-12, Block 22, Lots 5, 6, A, Block 25, Lots 1-6, Block 26, Lots 1-8, Block 27, Lots 1-12, McFaddin Second Addition, Block 1, Lots 7-12, Block 3, Lots E 1/4 of 8, 9, 10, Block 4, Lots 3-9, W '/2 of 10, Blocks 5-6, Lots 1-12, Block 7, Lots 4-10, W '/2 of 11, Block 8, Lots 1-5, E 3/4 of Lot 8, Lots 9-12, Block 9, Lots 1-12, Block 10, Lots 2-11, Block 11, Lots 4-6, Block 12, Lots 1-6, Block 13, Lots 1-3, Block 14, Lots W % of Lot 2, Lots 3-6, Block 15, Lots 1-6, City of Beaumont, Jefferson County, Texas, encompassing 202.01 acres of land, more or less, as shown on Exhibit"A" attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
