ENTITLED AN ORDINANCE ORDERING A GENERAL
ELECTION TO BE HELD IN THE CITY OF BEAUMONT
ON THE 4TH DAY OF MAY, 1996, AS PROVIDED BY
LAW, FOR THE PURPOSE OF ELECTING A MAYOR AND
TWO (2) COUNCILMEMBERS-AT-LARGE; PROVIDING
FOR PLACES WHERE SUCH ELECTION SHALL BE HELD;
APPOINTING AN EARLY VOTING BALLOT BOARD FOR
EARLY VOTING;APPOINTING A MANAGER AND JUDGE
OF THE CENTRAL COUNTING STATION; PROVIDING
FOR NOTICE THEREOF; ORDERING A RUNOFF
ELECTION IF NECESSARY TO BE HELD ON THE 18TH
DAY OF MAY, 1996; PROVIDING FOR JOINT ELECTION
WITH THE BEAUMONT INDEPENDENT SCHOOL
DISTRICT; PROVIDING FOR SEVERABILITY AND
PROVIDING FOR REPEAL.
WHEREAS, under the provisions of the Charter of the City of Beaumont and the laws
of the State of Texas relating thereto, a regular general municipal election is required to be
held in the City of Beaumont on May 4, 1996. The election shall be for the positions of
Mayor and two (2) Councilmembers-At-Large.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That in accordance with the provisions of the Charter of the City of Beaumont and
the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont
on May 4, 1996, a regular municipal election for said City for the purpose of electing a
Mayor and two (2) Councilmembers-At-Large.

Section 2.
That legally qualified voters residing within the corporate limits of the City of
Beaumont shall be entitled to a vote at said election.
Section 3.
That said election shall be held in the City of Beaumont between the hours of 7:00
a.m. and 7:00 p.m. at the places listed in Exhibit"A" attached hereto and made a part hereof
for all purposes and the persons whose names appear in Exhibit"A" are appointed presiding
judges and alternates for the respective voting boxes with authority to select and appoint
clerks.
The presiding judge for each election precinct shall appoint two (2) clerks and the
City Clerk may authorize as many additional clerks as are deemed necessary for the proper
conduct of the election.
Section 4.
That said election shall be held and the qualifications of those voting thereat shall be
controlled by the provisions of the Texas laws governing elections.
Section 5.
That notice of said election shall be given by publishing said notice as set out herein
in a newspaper of general circulation in this city and county one (1) time, not more than
thirty(30) days nor less than ten (10) days before said election. Said notice shall be in the
following form:

"NOTICE OF A GENERAL MUNICIPAL ELECTION IN THE
CITY OF BEAUMONT FOR THE PURPOSE OF ELECTING
A MAYOR AND TWO (2) COUNCILMEMBERS-AT-
LARGE."
"Notice is hereby given that a general municipal election, as
provided by the Charter of the City of Beaumont and the
statutes of the State of Texas, will be held in the City of
Beaumont on the 4th day of May, 1996, from 7:00 a.m. to 7:00
p.m. for the purpose of electing a Mayor and two
Councilmembers-At-Large."
That one copy of said notice shall be filed with the County Clerk of Jefferson County,
Texas and another copy shall be posted on a bulletin board in the office of said County Clerk
at least twenty (20) days prior to said election.
Section 6.
That the official ballot for the registering of the vote of the voters shall be as follows:

Section 7.
That an electronic voting system, as described by Title 8 of the Texas Election Code,
shall be used for said election and the following are hereby appointed officers of said
election to serve at the Central Counting Station which is hereby established at the Jefferson

County Mid-County Building: Manager of the Central Counting Station, Byron Broussard;
Tabulation Supervisor, Bob Crane; Presiding Judge of the Central Counting Station, the
Beaumont City Clerk. The official ballot cards and ballot labels, respectively, for the
election shall be prepared in accordance with the Texas Election Code. Early voting shall
be conducted by a clerk for Early Voting, namely the City Clerk. Early voting by personal
appearance shall be conducted at the City Hall, Room 125, 801 Main Street, Beaumont,
Texas, 77701. Early voting ballot applications and ballots voted by mail shall be sent to the
City Clerk's Office, P. O. Box 3827, Beaumont, Texas, 77704. Said clerk shall keep the said
office open for at least eight(8)hours between 8:00 a.m. and 5:00 p.m. on each day for early
voting which is not a Saturday, a Sunday, or an official State holiday; provided, however,
except as authorized by Section 85.005(a), Texas Election Code, said clerk shall not permit
anyone to vote early by personal appearance on any day which is not a regular working day
for the clerk's office, and under no circumstances shall she permit anyone to vote early by
personal appearance at any time when her office is not open to the public.
That early votes by personal appearance and by mail shall be counted by an early
voting ballot board consisting of a presiding judge and two clerks and the City Clerk may
authorize as many additional clerks as are deemed necessary. Barbara Fritschel, 4075 Laurel,
is hereby appointed Presiding Judge of the Early Voting Ballot Board and she shall appoint
the clerks.
Section 8.
That in accordance with the laws of the State of Texas, a runoff election, if necessary

to elect a Mayor, is ordered to be held on the 18th day of May, 1996, between the hours of
7:00 a.m. and 7:00 p.m., to be held at the same voting locations and with the same election
officers and judges as the general election.
Section 9.
That notice of the runoff election, if necessary to elect a Mayor, shall be given by
publishing said notice as set out herein in a newspaper of general circulation in this city and
county one (1)time, not later than the 10th day before election day. Said notice shall be in
the following form:
"NOTICE OF A RUNOFF ELECTION IN THE
CITY OF BEAUMONT FOR THE PURPOSE
OF ELECTING A MAYOR."
"Notice is hereby given that a runoff election, as
provided by the Charter of the City of Beaumont
and statutes of the State of Texas, will be held in
the City of Beaumont on the 18th day of May,
1996, from 7:00 a.m. to 7:00 p.m. for the purpose
of electing a Mayor."
That one copy of said notice shall be filed with the County Clerk of Jefferson County,
Texas, and another copy shall be posted on a bulletin board in the office of said County
Clerk at least ten (10) days prior to said election.
Section 10.
That the general election shall be held jointly with the Trustee Election of the
Beaumont Independent School District. The Beaumont Independent School District will
hold an election jointly with the City of Beaumont in thirteen (13) election precincts as set
out in the Order calling such election to elect two (2) trustees for the Beaumont Independent

School District. The election shall be held in accordance with the following terms of
agreement between the City of Beaumont and the Beaumont Independent School District:
a) The expenses of the election within joint precincts shall be divided with
each governmental entity paying an equal share of said expenses.
b) Single ballot forms shall be used which shall contain the Mayor and
Councilmembers-At-Large positions and BISD Trustee positions.
c) The herein-named election officers shall conduct the elections in said
election precincts.
d) Records for all elections shall be combined.
e) One set of ballot boxes and stub boxes shall be used for all elections.
f) Election returns shall be made on joint forms but the City Council of the
City of Beaumont shall canvass the returns of the General Municipal Election.
g) The City Clerk of the City of Beaumont is designated custodian of all
records and of the voting ballots.
Section 11.
That a copy of this ordinance, both in the English language and in the Spanish
language, signed by the Mayor of the City of Beaumont, Texas and attested by the City Clerk
of said city, shall constitute the notice ordering said election and the City Clerk is directed
to cause a copy of this ordinance, signed by the Mayor and attested by her, to be posted at
the City Hall in the City of Beaumont, Jefferson County, Texas, said posting to be not less
than twenty days prior to said election and to cause a copy of this ordinance, in English and
in Spanish, to be published on the same day in each of two successive weeks in some
newspaper of general circulation in the City of Beaumont, said publication to be made in

accordance with State law, the first such publication to be made not less than fourteen days
before the date of said election.
Section 12.
That this ordinance shall be finally passed on the date of its enactment and shall take
effect immediately upon its passage and signature by the Mayor. The City Clerk is hereby
authorized to attest to same and to affix the seal of the City of Beaumont hereto.
Section 13.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be
held to be invalid, such invalidity shall not affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance are declared to be
severable.
Section 14.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the
day of February, 1996.

GENERAL QUE SE TENDRA EN LA CIUDAD DE BEAUMONT EL
DIA 4 DE MAYO DE 1996 COMO PROVEIDO POR LEY, CON EL
PROPOSITO DE ELEGIR UN MAYOR Y DOS CONSEJALES SIN
LIMITES; PROYENDO LUGARES DONDE TENER TAL
ELECCION; NOMBANDO JUNTA DE REVISAR PARA LA
VOTACION DE LOS QUE VOTAN TEM-PRANO; NOMBRANDO
GERENTE Y JUEZ DE LA ESTACION DE CONTAR;
PROVEYENDO AVISO DE ESTO, DECRETANDO ELECCION DE
DESENPATE, SI NECESARIA QUE LA TENGA, EL DIA 18 DE
MAYO DE 1996. PROVEYENDO ELECCION UNIDA CON EL
DISTRICTO ESCOLAR INDEPENDIENTE BEAUMONT Y
PROVEYENDO POR SEPARACION Y PROVENDO LA
REVOCACION.
EN VISTA DE QUE, BAJO las leyes y provisiones de la Carte Constitucional de la Ciudad de
Beaumont y las leyes del Estado de Texas pertinente una elecci6n general municipal se requiere que se
tenga en la Ciudad de Beaumont el dia 4 de mayo do 1996. La elecci6n serd por los puestos deMayor
y dos consejales sin limites.
AHORA, POR ENDE, SEA DECRETADO POR LA
CIUDAD DE BEAUMONT
Seccion. 1
Que de acuerdo con las condiciones de la Carta Constitucional de la Ciudadde Beaumont y las
leyes delEstado de Texas, a esto pertinente, que se tenga en la Ciudad de Beaumont el dia 4 de mayo de
1996, una elleci6n general para dicha Ciudad con el prop6site de elegir un Mayor y dos Consejales sin
limites.

Seccion 2.
Que los votantes calificades dentre de los lfmites de la Ciudad de Beaumont serfin permitios a
votar en dicha elecci6n.
Seccion 3.
Que dicha elecci6n en la Ciudad de Beaumont se tenga entre las horas de 7:00 a.m. y 7:00 p.m.
en los lugares enumerados en la Muestra A y pegada a 6sta y hecha parte dee 6sta para todos prop6sites
y las personas cuyos nombres aparece en Muestra A estfin nombrados jueces gobernantes y supentes para
las respectivas cajas de votaci6n con la autoridad de nombrar empleados.
El juez gobernante de cada distrite electoral les nombrard a dos empleades y la Escribana de la
Ciudad uede nombrar tantos empleades adicionales como juzgado necesario para la buena marcha de la
elecci6n.
Seccion 4.
Que dicha elecci6n se tendril y las calificaciones para los vetantes en 6sta serdn controladas por
las provisioner de las leyes de Texas gobernando elecciones.
Seccion 5.
Que aviso de dicho elecci6n sera dada por publicar avise Qomo expresado en dsta en un peri6dico
de circulaci6n general de esta Ciudad y condado una (1) vez no menos de treinta (30) dfas ni menos que
diez (10) dfas antes de la elecci6n. Dicho aivso serd en la siguiente forma:
AVISO DE UNA ELECCION GENERAL MUNICIPAL EN LA
CIUDAD DE BEAUMONT PARA ELEGIR UN MAYOR Y DOS
CONSEJALES SIN LIMITES.
Aviso se da per dsta de una elecci6n general municipal como provefdo
en la Carta Constitucional de la Ciudad de Beaumont y los estatutes del

Estade de Texas, el dfa 4 de mayo de 1996, desde las heras de 7:00 a.m.
y 7:00 p.m. con el prop6sito de elegir un Mayor y des Consejales sin
lfmites.
Que una copia de dicho aviso sea archivado con la Escribana del Condado del Condado de
Jefferson, Texas y otra copia sea pegada en la tabilla de la Escribana del Condado no menos que veinte
(20) dia antes de la elecci6n.

Que la balota oficial para resiotrar el voto de los votantes serd como sique:

Seccion 7.
Que el sistema electr6nico de votaci6n como descrito per Tftule S del C6digo Electoral de Texas
sea usado para dicha elecci6n y que los siguientes estin por 6sta nombrados funcionarios de dicha
elecci6n para servir en la Estaci6n Central de Contar, la cual estd establecida en el Jefferson County Mid-
County building el Gerente de la Estraci6n Central de Contar, Bryon Broussard; el Supervisor de la
Tabulaci6n, Bob Crane; el Juez Gobernante de la Estaci6n de Contar la Escribana de la Ciudad de
Beaumont. La balota oficial y los marbetes y y las tarjetas respectivamente para la elecci6n serdn
preparados de acuerdo con el C6digo Electoral de Texas. La votaci6n de los que votan temprano serd

dirigida por un empleado para la Votaci6n Temproano, es decir la Escribana de la Ciudad. Aplicaciones
para los que votan por correo serAn enviadas a la Oficina de la Escribana de la Ciudad, P.O. Bos 3827,
Beaumont, Texas, 77704. Dicha escribana mantendra dicha oficina abierta por a to menos ocho (8)horas
entre las 8:00 a.m. y 5:00 p.m. cada dfa de la votaci6n temprana que no sea sAbado, domingo o dfa
oficial del Estado; condicioned sin embargo, excepto como autorizado por Secci6n 85.005 (a) C6digo de
Texas, dicho empleado no permitird a nadie votar por comparecencia personal en cualquier dfa que no
sea dfa regular de trabajo para la oficina de la Escribana, y bajo ninguna circumstancia permitira ella a
cualquiera persona votar temprano por comparecencia personal en cualquier tiempo que su oficina no est6
a bierta al publico.
Que los votos de los que votan por comparecencia personal y por correo serAn contados por un
consejo de juez gobernante y dos empleados y la Escribana de la Ciudad puede autorizar tantos empleados
adicinales como considerados necesarios. Barbara Fritschel, 4075 Laurel estd por 6sta nombrado Juez
Gobernante del Consejo de la Votaci6n Temprano y ella nombrarA los empleados.
Seccion 8.
Que de acuerdo con las leyes del Estado de Texas, si sea necesarai una elecci6n de desempate,
para elegir un Mayor estd decretado que al elecci6n sea el dfa 18 de mayo, 1996, entre las horas de 7:00
a.m. y 7:00 p.m. en los mismos lugares de votaci6n y con los mismos funcionarios que la elecci6n
general.
Seccion 9.

Que aviso de la eleci6n de desempate, si necesaria a elegir un Mayor. Serd dado por publicar
sicho aviso Como expuesto en 6sta en peri6dico de circulaci6n general en esta Ciudad y Condado una (1)
vez no mds tarde que el d6cimo (10) mo dfa antes de la elecci6n. Dicho aviso serd en la siguiente forma:
AVISO DE ELECION DE DESEMPATE EN LA CIUDAD DE
BEAUMONT PARA ELEGIR UN MAYOR.
Aviso se da por 6sta que elecci6n de desempate Como provefdo por la
Carta Constitutional de la se tendrA en la Ciudad de Beaumont el 18mo
dfa de may, 1996 desde las 7:00 a.m. y 7:00 p.m. para elegir Mayor.
Que una copia de dicho aviso ser archivado con la Escribana del Condado del Condado de
Jefferson, Texas, y otra copia serd pegada en la tabilla en la oficina de dicha Escribana del Condado, a
to menos dies (10) dfas antes de dicha elecci6n.
Section 10.
Que la elecci6n general se tendrA unida con la elecci6n de Fideicomisarios del Distrito Escolar
Independiente Beaumont en trece (13) distritos electorates como expuesto en la Orden decretando tal
elecci6n, tal elecci6n es para elegir dos fideicomisarios (2) para el Distrito Escolar Independiente
Beaumont. La elecci6n se tendril de acuerdo con las siguientes conditions de acuerdo entre la Ciudad
de Beaumont y el Distrito Escolar Independiente Beaumont:
a). Los gastos de la elecci6n dentro de los lugares unidos de votaci6n seran dividos con
cada gobierno pagando parte igual de dichos gastos.
b). Balotas sencillas serdn usadas las cuales contendrdn los puestos del Mayor y los
Consejales sin Lfmite y los Fideicomisarios de BISD.
c). Los funciinarios nombrdos en Este desarrollaran la elecci6n en dichos distritos
electorales.

d). Los resultados de todas elecciones seran combinados.
e). Un juego de urnas de balotas y los talons de las balotas seran usados para todas las
elecciones.
f). Los resultados de la elecci6n seran hechos en formas unidas pero el Consejo de la
Ciudad de Beaumont revisara los resultados de la elecci6n Municipal General.
g). La Escribana de la Ciudad de Beaumont esta designada custodia de todos los archivos
y de las balotas votadas.
Seccion 11.
Que una copia de esta ordenanza, en ambos Ing16s y Espanol, firpor el Mayor de la Ciudad de
Beaumont, Texas y ateatada por la Escribana de dicha Ciudad, esta dirigida a causar que una copia de
esta ordenanza, firmada por el Mayor y atestada por ella, sea pegada en el Ayuntamiento de la Ciudad
en la Ciudad de Beaumont, Condado de Jefferson, Texas, dicho pegaz6n a ser no menos que veinte dfas
antes de dicha elecci6n y de causar que una copia en Ing16s y Esponol sea publicada el mismo dfa de dos
semanas sucesivas en alglin peri6dico de cerculacion general en la Ciudad de Beaumont, dicha publicaci6n
sera hecha de acuerdo con la ley Estatal, dicha publicaci6n sera hecha no menos que catorce dfa antes
de la elecci6n.
Seccion 12.
Que esta ordenanza sera decretada finalmente en el dfa de su promulgaci6n ytomara efecto
inmediatamente al ser decretado y la firma del Mayor. La Escribana de la Ciudad esta a atestar la misma
y de poner el sello de la Ciudad de Beaumont a 6sta.
Seccion 13.
Que si alguna secci6n, subsecci6n frase o clausula de esta ordenanza o la aplicaci6n de la misma

alin grupo particular de personas o circumstancias suceda por cualquiera raz6n a ser declarada invdlida,
tal invalidez no afectard las porciones restantes de esta ordenanza, y a tal fin varias porciones y
provisiones de esta ordenanza estAn declaradas severables.
Seccion 14.
Todas ordenanzas o partes de ordenanzas en conflicto con 6sta estdn revocadas al punto del
conflicto nada mds.
DECRETADA POR EL CONSEJO DE LA CIUDAD de la Ciudad de Beaumont, este el to dfa
de febreri de 1996.
