ENTITLED AN ORDINANCE ESTABLISHING A MUNICIPAL
COURT BUILDING SECURITY FUND AND AUTHORIZING
THE COLLECTION OF A SECURITY FEE FROM PERSONS
CONVICTED IN MUNICIPAL COURT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
WHEREAS, the Legislature has amended the Code of Criminal Procedure to allow
the creation of a Municipal Court Building Security Fund to provide security services for
a municipal court; and,
WHEREAS, a $3.00 dollar security fee shall be collected to provide monies for such
fund;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY OF BEAUMONT:
Section 1.
THAT there is hereby established a Municipal Court Building Security Fund the money
from which may only be used for the purposes outlined in Article 102.017 of the Code of
Criminal Procedure to provide security services for Municipal Court.
Section 2.
The Clerk of the Municipal Court shall collect a $3.00 security fee from each person
convicted of a misdemeanor offense in Municipal Court from and after the effective date
of this Ordinance. For purposes of collection of this security fee a person is considered
convicted if a sentence is imposed on the person, the person receives community
supervision including deferred adjudication or the court defers final disposition of the case.
Section 3.
The City Manager be and he is hereby authorized to expend monies from the fund
in accordance with the ordinances of the City of Beaumont and laws of the State of Texas.
Section 4.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 5.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 6.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of the City of
Beaumont, Texas.
