BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a one (1) year contract
with Jefferson County Emergency Services District No. 1 to provide emergency medical
services to District No. 1 by the City's Emergency Medical Services System (EMS). The
contract is substantially in the form attached hereto as Exhibit "A."

CONTRACT
THE STATE OF TEXAS §
COUNTY OF JEFFERSON §
WHEREAS, the City Council of the City of Beaumont, by
resolution, has authorized its city representative, the City
Manager, to execute a one-year contract with Jefferson County
Emergency Services District No . 1 to provide emergency medical
services to said district, and
WHEREAS, emergency medical services are to be provided by the
City' s Emergency Medical Services System known as Beaumont EMS;
now, therefore:
THIS AGREEMENT, made and entered into this 17th day of
April, 1996, by and between the City of Beaumont, a municipal
corporation of. the State of Texas, hereinafter called "City",
acting herein- by and through its duly authorized City
representatives, and Jefferson County Emergency Services District
No . 1, created under Section 48e of Article III of the State
Constitution and Chapter 775 of the Health and Safety Code of the
State of Texas, hereinafter called the "District", acting herein by
and through its duly authorized representatives .
VJ I T N E S S E T H:
1 .
City shall provide emergency medical services for the sick,
injured, afflicted or disabled persons under emergency conditions
within the District. City does hereby agree to accept such

engagement and employment and to discharge such duties in
accordance with the terms and conditions herein set forth .
City shall provide emergency medical services to the District
when requested and as personnel and equipment are available to
respond to said requests; however, City shall use due diligence to
provide prompt response to said requests . Requests for
transportation of nonemergency patients will not be accepted.

During the terms of this Contract, the District shall pay to
the City the sum of FOUR THOUSAND TWENTY-SEVEN AND 50/100 DOLLARS
($4 , 027 . 50) for emergency medical services provided pursuant to
this Contract . t
4 .
The District hereby agrees to procure a policy of Liability
Insurance in the amount of at least Five Hundred Thousand Dollars
($500, 000.00) and to name the City as an additional named insured.

The District shall comply with all laws applicable to its
activities.
6.
This agreement shall be deemed to be made and shall be
construed in accordance with the laws of the State of Texas and
shall be performable in Jefferson County, Texas .

Either party may terminate this agreement by giving sixty ( 60)
days written notice to the other party. In the event this contract
is terminated by either party, the contract amount provided for in
Paragraph 3 above shall be prorated to the date of termination.

All notices required to be given hereunder by City to the
District shall be in writing by mail or telegram, postage prepaid,
and addressed to the District as follows :

All notices required to be given hereunder by the District' to
City shall be in writing by mail or telegram, postage prepaid, and
addressed to the City of Beaumont, as follows :

The terms of this agreement shall be in force from the 1st day
of April, 1996 until the 31st day of March, 1997 .
