ENTITLED AN ORDINANCE AMENDING CHAPTER 26,
SECTION 26-13, OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT TO ADD A NEW SUBSECTION 26-
13(24); PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 26, Section 26-13, of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to add a new subsection 26-13(24)to read
as follows:
"Sec. 26-13. Authority for traffic control.
"(24) To issue oversize load permits to those vehicles which, because of
their height, weight, length, or width, exceed the state limits. The fee
for such issuance is fifty dollars ($50.00). Any person moving or
causing to be moved a load as set out in said permit shall be liable to
the city for any damage done by any such vehicle to the streets,
bridges, or culverts in the city and acceptance of the aforesaid permit
shall be conclusive evidence that the person to whom such permit is
issued agrees to pay all such damages upon demand thereof made
by the city."
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 4.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
Section 5.
This ordinance shall be effective from and after January 1, 2004.
