REQUESTED ACTION: Council consider an ordinance authorizing the disannexation of a

RECOMMENDATION
Administration recommends the disannexation of a 68.57± acre tract out of the David Brown
League, Abstract 5.
BACKGROUND
In January 2002,Exxon Mobil and the City entered into an Industrial District Agreement. The City
establishes industrial agreements within the extraterritorial jurisdiction of the City. Under the
agreements,a company recognizes the benefits and an obligation to contribute to the revenues of the
City in an amount commensurate with the burdens placed upon the City. In conjunction with the
Industrial District Agreement,Exxon Mobil and the City entered into an agreement for the purposes
of disannexing certain properties, preventing reannexation of said properties and providing
consideration for disannexation of the property.The property to be disannexed is now entirely owned
by Exxon Mobil.
Since January 2002, the City has abandoned street and alley rights-of-ways in accordance with the
terms of the disannexation agreement. Additionally,utilities have been or will be disconnected to the
property proposed for disannexation.It is the City's intention to cease providing services in this area.
Currently under state law, there are only two methods of disannexing property. The first method
allows disannexation of property that has no improvements such as streets and utilities. The second
method allows for the disannexation of the property if a majority of the qualified voters of the area
petition the city to disannex the area if the city fails or refuses to provide services or cause services
to be provided to the area within the period specified by state statute. The City received a petition
on November 26, 2003 requesting this property be disannexed. Since the City is not intending to
provide services to this area, the submittal of the petition is appropriate.
PREVIOUS ACTION
The City Council authorized the City Manager to execute the Industrial District Agreement and the
disannexation agreement and has approved the abandonment of several street and alley rights-of-
ways.

Consider Ordinances increasing various fees charged by the City as discussed during the
December 2,2003 work session and summarized as follows:

RECOMMENDATION
Administration recommends that the City Council approve the proposed fee increases effective
January 1,2004.
BACKGROUND
Many of the fees charged by the City for services are set by various ordinances. Such fees have
recently been reviewed taking into consideration what others are charging for similar services as
well as the date of the last increase in rate by the City.
BUDGETARY IMPACT
It is estimated that the recommended increases will result in$130,000 to $140,000 per year in
additional revenues to the General Fund and approximately$70,000 in additional revenues per
year to the Water Fund.
PREVIOUS ACTION
Various ordinances relating to these fees have been adopted from 1984 to the present.
SUBSEQUENT ACTION
A Power Point presentation was made to Council on December 2,2003 with recommendations
for increases. A copy of that presentation is attached.

ENTITLED AN ORDINANCE AMENDING CHAPTER 26,
SECTION 26-13, OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT TO ADD A NEW SUBSECTION 26-
13(24); PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 26, Section 26-13, of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to add a new subsection 26-13(24)to read
as follows:
"Sec. 26-13. Authority for traffic control.
"(24) To issue oversize load permits to those vehicles which, because of
their height, weight, length, or width, exceed the state limits. The fee
for such issuance is fifty dollars ($50.00). Any person moving or
causing to be moved a load as set out in said permit shall be liable to
the city for any damage done by any such vehicle to the streets,
bridges, or culverts in the city and acceptance of the aforesaid permit
shall be conclusive evidence that the person to whom such permit is
issued agrees to pay all such damages upon demand thereof made
by the city."
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.

That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 4.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
Section 5.
This ordinance shall be effective from and after January 1, 2004.

ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
TO AMEND FEES FOR ZONE CHANGE AND SPECIFIC USE
PERMIT APPLICATIONS AND VARIANCES AND SPECIAL
EXCEPTIONS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL; PROVIDING A PENALTY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 30, Section 30-37(i), of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:
"Sec. 30-37. Board of Adjustment.
(i) Notification and hearing process.Any request for an appeal, variance
or special exception shall require a public hearing before the board. Notice
of said hearing shall be published at least one time in a newspaper of the
City of Beaumont, at least ten (10) days prior to the day of the hearing. A
written notice of the hearing shall be sent to owners of property situated
within two hundred (200) feet of the exterior boundary of the property with
respect to which such appeal, variance or exception is requested. It shall be
sufficient that such written notice is addressed to the owner appearing on the
most current tax roll of the city and addressed to such owner at the address
stated on said roll. If no owner is stated on the tax roll, or no address
appears thereon, the written notice to such property owner shall not be
required.A processing fee of two hundred fifty dollars($250.00)shall be paid
to the city in advance of the hearing. In the event the application is withdrawn
prior to the mailing of the required written notification of publication in the
official newspaper, the fee shall be refunded."
Section 2.
THAT Chapter 30, Section 30-39(d), of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:

"Sec. 30-39. Historic Landmark Commission.
(d) Certificates of appropriateness. No person or entity shall construct,
reconstruct, alter, change, restore, remove or demolish any exterior
architectural feature of a building or structure located in an H-C,
Historical--Cultural Landmark Preservation District, unless the application
has been made to the historic landmark commission for a certificate of
appropriateness and such certificate shall have been granted. The applicant
shall pay a fee of twenty dollars ($20.00) for the issuance of a certificate of
appropriateness. The term "exterior architectural feature" shall include but
not be limited to the kind, color and basic texture of all exterior building
materials and such features as windows, doors, lights, signs and other
exterior fixtures."
Section 3.
THAT Chapter 30, Section 30-40(e), of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:
"Sec. 30-40. Changes, amendments, and specific use permits.
(e) Application fee.Any person, firm or corporation applying for a change
in the zoning district classification of any property or a specific use permit
shall be required to pay an application processing fee of two hundred fifty
dollars($250.00) if the property involved is less than one-half( 1/2)acre;four
hundred fifty dollars ($450.00) if the property involved is greater than
one-half (%) acre but less than five (5) acres; and six hundred fifty dollars
($650.00) if the property involved is greater than five (5) acres. The
processing fees as established herein shall be paid at the time of the filing
of an application. In the event the application is withdrawn prior to the mailing
of the required written notification or publication in a newspaper,the fee shall
be refunded. Any person, firm or corporation requesting an abandonment of
city right-of-way or easements shall be required to pay an application
processing fee of three hundred dollars ($300.00) at the time of such
application. The fee for processing other requests under the other business
category shall be one hundred dollars ($100.00), required at the time of
application."

PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING FOR A PENALTY; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 10, Section 10-3(b), of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:
"Sec. 10-3. Fire service fees.
(b) The following fees are hereby set for the following fire services or
occurrences:
Service Fee
1. Annual inspection fee required for target hazards,
including, but not limited to, hospitals, nursing
homes, assisted living centers, and other such
properties which require multiple yearly

2. Annual inspection fee required for state licensed

"Every person, partnership or corporation desiring to obtain an ambulance
permit shall make application in writing on a form provided by the city for that
purpose to the health authority. Such application shall contain the name,
address,and telephone number of the applicant,the owner of the ambulance
for which the permit is to be issued, and the address and telephone number
of the location from which ambulance service will be originated. The
application shall also show the make, model, motor number, and correct
state license number of the ambulance for which a permit is being requested.
Every application when filed shall be sworn to by the applicant and shall be
accompanied by a permit fee of twenty dollars ($20.00). No permit shall be
transferable and every permit shall expire one year from the date of
issuance. Each ambulance company desiring to do business in the City of
Beaumont shall, in addition to the fee for each unit permitted, pay an annual
fee of one hundred dollars ($100.00)."

It shall be unlawful for a nonresident of the city to check out any item from the
Beaumont Public Library unless such person holds a nonresident library card issued under
the following terms and conditions:
(1) A nonresident individual card at a cost of Twenty-Five ($25) Dollars per year
will entitle the holder to check out a maximum of four(4) items at any one time
if otherwise allowed by existing library rules for each item.
(2) A nonresident family card at a cost of Forty ($40) Dollars per year will entitle
the holder to check out a maximum of eight (8) items if otherwise allowed by
existing library rules for each item.

ENTITLED AN ORDINANCE AMENDING CHAPTER 28,
SECTION 28-52(b), OF THE CODE OF ORDINANCES OF
THE CITY OF BEAUMONT TO AMEND SERVICE CHARGES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
THAT Chapter 28, Section 28-52(b), of the Code of Ordinances of the City of
Beaumont be and the same is hereby amended to read as follows:
"Sec. 28-52. Payment of charges and deposits.
(b) Failure or refusal by any customer to pay any bill to the city,
upon demand, shall constitute a breach of contract, and water and sewer
service may,within ten (10)days from notice of such failure, be discontinued
to the customer, and, at the discretion of the finance officer, such services
shall not be renewed until the customer has paid all delinquent bills, plus the
following applicable service charges:

Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this

ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 4.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
Section 5.
This ordinance shall be effective from and after January 1, 2004.

RECOMMENDATION
The Administration recommends funding the Partnership of Southeast Texas $15,000 for FY2004
from the City's General Fund.
BACKGROUND
The Partnership of Southeast Texas(POST)is a nonprofit,economic development corporation that
works to develop cooperative efforts on a regional basis. Its purpose is to facilitate the retention and
creation of jobs in a nine-county area that includes Chambers, Hardin, Jasper, Jefferson, Liberty,
Newton, Orange and Tyler Counties and the Bolivar Peninsula in Galveston County.
BUDGETARY IMPACT
Funds are available in the FY2004 General Fund budget.

Dear Mayor Lord and Council Members:
Thank you for allowing me, Angie Colligan_and our chair, Barbara Knight to appear before
you at the November 4th City Council meeting to present information concerning the
Partnership of Southeast Texas (POST).
I sincerely apologize for not having the empirical data concerning jobs for Beaumont at the
previous meeting. POST typically records information on prospects and projects by county.
Since the last meeting, we have researched our database and compiled the following
information that I hope will answer your questions.
• To date in 2003 (November 10), the Partnership of Southeast Texas (POST) has worked
with a total of 254 prospects and projects in the region.
• A total of 181 of those tasks involved Jefferson County— 72% of POST's efforts.
• Of that Jefferson County total, 118 were prospects (companies) -- 67 new or relocating
businesses and 51 existing businesses.
• Of the 118 prospects involving Jefferson County, 30 were for Beaumont alone and 27
were for Beaumont and other locations.
Jobs and Investment
The 118 Jefferson County leads represent 6,352 potential jobs and an estimated $2.9 billion
in potential new investment. Typically leads for businesses span from 18 to 24 months
before a decision is made.
The following are some of the projects that POST has worked on during the past few years
that have affected Beaumont resulting in a net gain of more than 8,500 jobs.
Back Office— In 1996 POST and Entergy began a program to get the area"on the radar
screen"for back office operations. We did two missions to Omaha, Nebraska and the
New Jersey/New York area. About half the calls were to back office consultants.
Shortly thereafter we began receiving leads from numerous consultants. This led to the
first large-scale back office in the area—what is now Spherion. That track continued
with even more leads coming after that and the landing of West Corporation and Service
Zone (Port Arthur).
EPCO— POST took this prospect for a tour of the region and discussed each plant's
products with him. Originally he was looking for a refinery to get his carbon dioxide. But

when we showed him the ammonia facility at DuPont, he keyed in on that and eventually
located next to it so he could take carbon dioxide from DuPont's complex.
A &A Fertilizer— POST was instrumental in getting this company to consider Neches
Industrial Park.
Crockett Street—Before the project was firmed up, the developer, Tom Flannigan,
asked POST to come meet with him and let him know of any programs that could help
make the project financially viable. After going through the list of state programs that are
mainly keyed to manufacturing, we told him that the Texas Capital Fund could be used
to fund off-site improvements. The city was an entitlement community meaning that it
did not have to compete for the funds and the decision making was in city hands. He
later received these funds for road and sign improvements.
Goodyear— During the time the city was wooing this project, POST was able to spot a
tax error on the property for the new facility that saves Goodyear more than $100,000 a
year.
U.S. Bar Coding facility— POST (SET Inc. at the time) played a major role in attracting
this company to Beaumont.
Prisons —SET Inc. was on the team for attracting each of the prison and did a major
role in preparing the proposals.
Tax Credit Financing —Last year, POST worked with Al Price and the Southeast
Texas Community Development Corp. to put together an application seeking New
Market Tax Credits for a local lending program. Although the corporation was not
successful in getting that allocation, we have been able to use the knowledge of the
program to help other projects seek financing from other organizations that do have the
NMTC credits. This included an inquiry from the Beaumont Chamber on behalf of a
local project.
Southeast Texas Entertainment Complex—Through working on another prospect,
POST introduced Judge Carl Griffith to the standing offer that the Phelan's had made to
donate 50 acres of land for an economic development project. POST has been involved
in continuing planning for the project serving on two of the committees designing
facilities.
Projects
The 63 projects (as opposed to prospects) involving Jefferson County were ones that POST
assisted with marketing efforts, gathering data. Some examples:
• Showing a TxED official industrial assets of the Golden Triangle.
• Gathering data for economist who does an economy report for a series of banks.
• Kathleen Jackson with Exxon-Mobil had a call from a Texas Monthly magazine
reporter and surmised that he was doing an article critical of the Golden Triangle.
POST gathered background and discussed it with the reporter to get a more
balanced view presented.

• Working on getting a business incubator for the area.
• Several projects to help LSET, including LSET day in Austin.
• Assisting two Leadership Beaumont teams on their presentations.
• Setting up the Big 9 Online directory - a directory requested by Jefferson
County to help local companies get contracts with firms seeking tax abatements.
• Gathering background data requested by Tom Stellman, doing the Beaumont
target marketing plan.
• Setting up a 501 c3 to allow POST to seek alternate funding sources.
• Assisting Lamar University Continuing Education department to assess the need
for environmental classes and help with marketing them.
• Assisting the Flight Fest celebration with marketing
I hope this letter better clarifies what POST does on behalf of your city to assist in the effort of
securing new businesses and jobs. If you require information concerning our efforts, please

RECOMMENDATION
The Administration recommends that City Council authorize the City Manager to approve an amendment to
a$3 50,000 contract with the Southeast Texas Community Development Corporation in the amount of$50,100
to cover the cost of infrastructure at the old Dick Dowling school site.
BACKGROUND
As per Resolution#03-058 dated March 4,2003,the Southeast Texas Community Development Corporation
(SETCDC)was awarded a contract in the amount of$350,000 for costs associated with the construction of
ten(10)new homes at the Dick Dowling school site. The site has been re-platted and infrastructure is required
to install water and sewer utilities for a subdivision. SETCDC received bids from two contractors for the
required infrastructure. The proposal from the lowest bidder,Barnes Trucking&Equipment, is attached for
your review.
BUDGETARY IMPACT
Funding is available from the 2002 Consolidated Block Grant Program, Infrastructure line item. There is
$145,000 available in this line item.
PREVIOUS ACTION
Council previously authorized a contract for $350,000 to the Southeast Texas Community Development
Corporation for the development of affordable housing in neighborhoods targeted for revitalization.

RECOMMENDATION
Administration recommends the purchase of thirty(30)laptop computers for$1,871.89 each from
Dell Computer Corporation of Round Rock, Texas for the Police Department.
BACKGROUND
The State of Texas Cooperative Purchasing Program offers the Catalog Purchasing Program for the
purchase ofhigh technology items. A list of qualified Catalog Information Services Vendors(CISV)
is provided by the State for the procurement of high technology goods such as personal computers,
software, and telecommunications systems. Vendors must offer a published catalog or an Internet
site describing their products and prices. Local entities must contact a minimum of three(3)vendors
for furnishing bids on specified products. In addition to price,the award of the bid may be based on
criteria such as technical support,expansion and upgrading,and compatibility with existing systems.
Bids were solicited from eight(8)CISV companies for thirty(30)laptop computers with a minimum
2.6 Gigahertz (GHz) processor, 30 Gigabyte (GB) Hard Drive, and 256 Megabyte (MB) Random
Access Memory (RAM). The new laptop computers will be used by the Police Department to
replace outdated laptop computers which cannot support the upgraded electronic offense reporting
system. The upgraded electronic offense reporting system allows more timely and accurate offense
reporting, case filing, and information retrieval by investigative staff.

Fund of the Texas Municipal Retirement System (TMRS) at the
actuarially determined rate applied to total civilian and police
compensation to become effective January 1,2004.
RECOMMENDATION:
The Administration requests approval of the ordinance to allow and provide for funding to TMRS
for the 2004 year.
BACKGROUND:
TMRS is the retirement plan used for civilian and police civil service personnel. Fire civil service
personnel are covered by the Beaumont Fireman's Relief&Retirement Fund, a separate entity.
Annually,the actuary for TMRS calculates the contribution rate necessary for funding the plan for
the upcoming year based on the benefits adopted within the City's retirement plan. The 2004
calculated contribution rate is 12.25%of payroll. This is composed of normal costs of 8.35%and
prior service costs of 3.90%. The contribution rate for 2003 was 11.88%of payroll.
BUDGETARY IMPACT:
Based on an estimated compensation of $38.6M, the projected annual cost for the plan is
approximately$43M.

On September 23,2002 an ordinance was enacted to provide for increased prior and current service
annuities of 70%of the Consumer Price Index for all retirees and beneficiaries of deceased retirees
of the City who retired through TMRS which became effective January 1, 2003.

COMPENSATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
WHEREAS, the City of Beaumont (the "City"), is a participating municipality in the
Texas Municipal Retirement System(the"System"), and has undertaken to provide certain
retirement, death and disability benefits to its employees pursuant to Subtitle G, Title 8,
Government Code, (hereinafter, the "TMRS Act"); and,
Whereas, the City Council desires to authorize funding of such benefits as herein
provided;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY OF BEAUMONT:
Section 1.
Pursuant to Section 855.407(g) of the TMRS Act, the City hereby elects to make
future normal and prior service contributions to its account in the municipal accumulation
fund of the System at such combined rate of the total compensation paid by the City to
employees who are members of the System, as the System's actuary shall annually
determine as the rate necessary to fund, within the amortization period determined as
applicable to the City under the TMRS Act, the costs of all benefits which are or may
become chargeable to or are to be paid out of the City's account in said accumulation fund,

regardless of other provisions of the TMRS Act limiting the combined rate of City
contributions.
Section 2.
The provisions of the ordinance shall become effective on the 1s' day of January,
2004.

RECOMMENDATION
Drainage District #6 has agreed to convey a water tower site [Special Warranty Deed] and an
adjacent thirty foot (30') wide Utility Easement, along the south side of Dishman Road, to the
City of Beaumont. The property is described as:
Tract 1 Water Tower Site - a 0.918 acre tract of land in the A. Houston Survey,
Abstract 33 [200' x 200'].
Tract 2 Utility Easement - a 0.132 acre tract of land in the A. Houston Survey,
Abstract 33 [adjacent to and east of water tower site]
Administration recommends acceptance of the water tower site and utility easement.
BACKGROUND
The Water Utilities Division is constructing a new water tower and the easement will allow the
tying in of the new site with existing water and sewer facilities.

REQUESTED ACTION: Council approval of the payment of an invoice for an annual software
support agreement for a Motorola Mobile Data Communication
System(MDC).
RECOMMENDATION
Administration recommends payment of an invoice to Motorola in the amount of$34,544.35 for
software support for a period of one(1)year.
BACKGROUND
The software maintenance agreement provides for twenty-four(24)hour support and updates to the
vendor's software during the contract period. Currently,there are 118 MDC's installed in the City's
Police, Fire, and Emergency Medical Service vehicles.
In 1999, the City purchased the mobile data communication system for the Police Department. An
MDC is a wireless data communications system providing officers with direct access to the host
Computer Aided Dispatch (CAD) system. The system provides officers with the ability to access
information from the National Crime Information Center,Texas Crime information Center and from
the City's AS400 mainframe computer. Complete case files from the AS400 database can be
accessed providing field officers with detailed graphical images including fingerprints, photographs,
maps and diagrams.
This purchase is exempt from competitive bidding since it is available from only one(1)source having
exclusive rights to modify and maintain the software.
BUDGETARY IMPACT
Funds are available in the Confiscated Goods Fund.
