HomeMy WebLinkAboutRES 98-156 RESOLUTION NO. 5�/�"6 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to execute a contract with the Federal Bureau of Prisons, Federal Correctional Complex of Beaumont to provide emergency fire protection services. The contract is substantially in the form attached hereto as Exhibit "A." PASSED BY THE CITY COUNCIL of the City of Beaumont this the,?,YAe day of 1998. - Mayor - Pro Tem INTERGOVERNMENTAL AGREEMENT #463-2 between UNITED STATES DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF PRISONS, FEDERAL CORRECTIONAL COMPLEX, ]BIEAUMONT, TEXAS, and the CITY OF IBIEAUMONT, TEXAS I. Purpose This agreement establishes the terms and conditions through which emergency fire protection services will be provided to the United States Department of Justice, Federal Bureau of Prisons, Federal Correctional Complex, Beaumont, Texas, hereinafter referred to as the FCC, by the City of Beaumont, hereinafter referred to as the City II. scope This agreement shall include all property located ai the FCC, Route 4 Box 5000, Hebert Road, Beaumont, Texas. This agreement becomes effective when signed by.both parties and will remain in effect until terminated as outlined in paragraph V. III. Aufhority This agreement is entered into under the authority of Federal Bureau of Prisons Program Statement No. 4100.03, $ureau of Prisons Acquisition Policv, as authorized by the Federal Grant and Cooperative Agreement Act. ITV,' Periodic Review This,agreement shall 6&'reviewed annually or upon written request of either party. V.�Ckan4es or Termination a. Changes to this agreement by either party will be documented, sequentially numbered, signed by both parties, and attached to this document as a permanent part hereof. The required approval level for these changes shall be the signatories of this agreement or their properly designated representatives. b. This agreement may be terminated with 120 days written notification of either party or by _ - 1 - EXHIBIT "A" mutual agreement. c. Notwithstanding the aforementioned provisions, this agreement shall terminate June 30, 2000, unless renegotiated earlier. VI. Agency Interface a. The following individuals are responsible for coordinating the impteiientation and execution of this agreement. Principals identified above may delegate the functions of administration and coordination of this agreement. Negotiation of modifications to,the agreement is reserved to the principals identified in the above paragraph. VII. Funding Funds for this agreement will be obliga.ted on.-a"xyearly basis from the date in which the agreement is approved by both parties. The FCC agrees'fo pay the City $ 3000.00 per year for performance detailed in paragraph XIS It is the intent of the parties,that this contradfor emergency fire protection services does not preclude the City from seeking reimbursement for further cost of firefighting on FCC property pursuant to title 15 U.S.C. 2210. VIII. Billing and N' enf; The FCC will make four(4).;semi-annual payments in the amount of$ 1500.00 following the receipt of an approved invoice. Payment will be made in accordance with Bureau of Prisons p§gcy and the Prompt:POyment Act. The invoices should reference Intergovernmental Agreement#463 2 and be submitted semi-annually to the following address: Federal Correctional Complex P:O BoX'260Y 5 Beaumont, Texas 77720-6015 Attn: Accounts Payable - 2 - IX. Anti-Deficiency Act Nothing contained herein shall be construed to obligate the Federal Bureau of Prisons to any expenditure or obligation of funds in excess or in advance of appropriations in accordance with the Anti-Deficiency Act, 31 U.S.C., Section 1341, as amended. X. FCC Beaumont Responsibilities a. The FCC will provide assistance to Fire Department personnel during emergency situations requiring fire protection services. b. Fire hydrants are available for use by the City, for water supply, at strategic locations throughout the FCC. c. The FCC will provide the City with a tour and written overview of institutional policies and regulations regarding access to the institutions, as deemed necessary by the FCC Safety Manager and City Fire Chief d. The FCC will provide security for the City's equipment an d personnel while providing fire protection services within the secure perimeter of all FCC institutions. X.I. City Of Beaumont Responsihilifies a. The City will provide em6rgericy fire protection services twenty-four(24) hours per day, seven (7),days per week Equipiiaent and supplies shall be provided by the City. b. The City Fire Chief and VQQ Safety Manager shall insure the City is adequately familiar with the FCC premis� forp��poses of�".roviding necessary fire protection. .. MI.
