BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute an Inter-local
Agreement with DD#6 for the construction of a new outfall in the Walden Road area. The
agreement is substantially in the form attached hereto as Exhibit "A."

INTER-LOCAL AGREEMENT

This contract is made by and between the City of Beaumont, a home rule City of the State of
Texas(hereinafter called"City")and Jefferson County Drainage District No. 6, a special district of
the State of Texas(hereinafter called"District")under authority of the Inter-local Cooperation Act,
Texas Revised Statutes ANN.Article 4413 (32c). The City and District agree as follows:
WITNESSETH:
The City and District agree that it would be advantageous to design, acquire right-of-way,
adjust utilities and construct a ditch that would generally serve the area north of Walden Road from
IH-10 west to District Ditch No. 109(hereinafter called"Project").
Specifically,the City agrees to the following:
• The City will be responsible for the acquisition of the necessary right-
of-way. (Estimated cost is$250,000.)
• The City shall provide adequate spoil areas.
• The City will be responsible for procurement of the pipe/box culverts
and the cost of the concrete lined section of the ditch as identified in
the plans and specifications. (Estimated cost is$252,000.)
• The City will be responsible for the cost of utility and pipeline
adjustments. (Estimated cost is$50,000.)
• The City will reimburse the District for engineering services,
including the preparation of plans/specifications and construction
inspection of the concrete lined section of the project. (Estimated cost
is$33,000.)
• The City will reimburse the District within thirty(30)days, as billed
by the District on a bimonthly basis.

EXHIBIT "A"
INTER-LOCAL AGREEMENT
Jefferson County Drainage District
No.6 and the City of Beaumont
Specifically, the Drainage District No. 6 agrees to the following:
• The District will excavate the proposed channel, beginning at the
intersection of the existing Ditch No. 109 located on the west
boundary line of Lot 5 of the T.H.Langham Subdivision and ending
at the beginning of the concrete transition area as related to the box
culvert portion of said proposed outfall channel.
• The District will distribute spoil and set culverts at specified locations.
• The District will furnish material, labor and equipment to support the
natural gas pipeline in its present location.
• The District will replace any fencing affected by said project with new
fencing.
