HomeMy WebLinkAboutORD 94-65 ORDINANCE NO. < t.� ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1079 Isla 899 Arabella 870 Central Drive 1072 Forrest 870 Central Drive (Garage) 1180 Magnolia (Garage Apt.) 990 Dixie (Rear Shed) 2574-76 Magnolia 990 Dixie 2711 Magnolia 1055 Madison 1190 Delaware 3582 Goliad 3340 E. Lucas 3516 Edmonds 695 Delaware 1298 Roberts (Garage) 535 Brockman 1370 Bolivar each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the 1 following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1079 Isla 899 Arabella 870 Central Drive 1072 Forrest 870 Central Drive (Garage) 1180 Magnolia (Garage Apt.) 990 Dixie (Rear Shed) 2574-76 Magnolia 990 Dixie 2711 Magnolia 1190 Delaware 3582 Goliad 3340 E. Lucas 3516 Edmonds 695 Delaware 1298 Roberts (Garage) 535 Brockman 1370 Bolivar Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings either demolish or repair said structures within ninety(90) days of the effective date of this ordinance: 1055 Madison Section 4. The owners of the structures listed below have executed Demolition Consent Forms authorizing the City to demolish the structures. The structures meet the criteria of a dangerous structure and have deteriorated such that they are no longer suitable for repair. Therefore, the following structures are hereby authorized to be demolished by the City. 958 Orange 1277-79 Laurel 2 Section 5. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were heretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 2660 Atlanta 1138 Victoria Cts. 5730 Bigner Road 1140 Victoria Cts. 2408-12 Cable (Apts.) 1148 Victoria Cts. 2420-24 Cable (Apts.) 1150 Victoria Cts. 1838 Corley 1158 Victoria Cts. 895 Doucette 1160 Victoria Cts. 760-62 Irby (Apt.) 1168 Victoria Cts. 750 Neches 1180 Victoria Cts. 1855 Pierce 1190 Victoria Cts. 3830 Scranton 1198 Victoria Cts. 1060 Trinidad Section 6. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 7. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 3 PASSED BY THE CITY COUNCIL of the City of Beaumont this the 17?a� day of �� , 1994.
