ORDINANCE NO. -23L-
ENTITLED AN ORDINANCE GRANTING A SPECIFIC
USE PERMIT TO ALLOW A SINGLE FAMILY
RESIDENCE WITH A TOTAL HEIGHT OF 43 FEET ON
LAND ZONED RS (RESIDENTIAL SINGLE FAMILY
DWELLING DISTRICT) AT 1850 THOMAS ROAD IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific use
permit to Mark D. Merrill to allow a single family residence with a total height of 43 feet
on land zoned RS (Residential Single Family Dwelling District) on 1.3 acres, more or less,
being Lot 30-A, Blue Star Addition (replat) and Tract 11-U, Plat D-25, H. Williams Survey,
as shown on Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met and
a specific use permit to allow a single family residence with a total height of 43 feet on land
zoned RS (Residential Single Family Dwelling District) on 1.3 acres, more or less,being Lot
Y
30-A, Blue Star Addition (replat) and Tract 11-U, Plat D-25, H. Williams Survey, in
Beaumont, Jefferson County, Texas is hereby granted to Mark D. Merrill, his legal
representatives, successors and assigns for those certain tracts described on Exhibit "A"
attached hereto and made a part hereof for all purposes, subject to the above conditions.
Section 2.
That the specific use permit herein granted is expressly issued for and in accordance
with each particular and detail of the site plan attached hereto as Exhibit 'B" and made a
part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

At a Joint Public Hearing on 9/19/94, the Planning Commission voted 6:3 to
approve a specific use permit allowing a 42' height, subject to the owner's
construction of a 10'-12' tall fence or wall along his south property line
and by installing second story frosted glass windows facing south. y••« R• •-•
......... On 9/27/94 City Council approved height of 43' with minims-.of a 10' tall fence
or wall constructed of materials consistent with residence and by installing second
story frosted glass windows facing south.
