OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTICULAR THE BOUNDARIES OF
THE ZONING DISTRICTS, AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING
THE ZONING OF PROPERTY PRESENTLY ZONED RS
(RESIDENTIAL SINGLE FAMILY DWELLING)DISTRICT
TO NC (NEIGHBORHOOD COMMERCIAL) DISTRICT
FOR PROPERTY LOCATED AT 6030 AND 6040
CONCORD ROAD, CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the zoning
of property presently zoned as RS (Residential Single Family Dwelling) District to NC
(Neighborhood Commercial) District for property located at 6030 and 6040 Concord Road,
being:
portions of Tracts 24 and 25, Plat D23 of the Frederick Bigner
Survey, described as follows: Beginning at a 3/4 Inch iron pin
located at the Southeast corner of Tract 25, the same being the
Southwest corner of the Associated Investors 6.03 acre tract,
said 3/4 Inch iron pin also being in the northeasterly right of
way line of Concord Road; Thence North 24 Degrees 26
Minutes 04 Seconds East with an old fence line 200.0 Feet more
or less to the Point of Beginning; Thence North 24 Degrees 26
Minutes 04 Seconds East with an old fence line 273.95 Feet
more or less to a 3/4 Inch iron pipe for a corner in the common
line of the Frederick Bigner Survey and the Thomas Spear
League; Thence South 89 Degrees 48 Minutes 23 Seconds West
with an old fence line 169.47 Feet, and along the said common
line of the Frederick Bigner Survey and Thomas Spear League,
to a 3/4 Inch iron pipe for a corner; Thence West along the
north boundary line of Tract 24 and said Bigner Survey 126.2
Feet to a gas pipe stake for a corner and which is the northeast
corner of the A.P. Miller tract of land; Thence South 17
Degrees 22 Minutes West on Miller's east line 121.21 Feet more
or less to a point; Thence South 58 Degrees 15 Minutes East
125 Feet more or less to a point; Thence South 59 Degrees 35
Minutes 29 Seconds East 131 Feet more or less to the Point of
Beginning, containing 1.25 acres more or less,
Beaumont, Jefferson County, Texas, as shown on Exhibit "A" attached hereto and made a
part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance,
and to such end, the various portions and provisions of this ordinance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
