ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW THE MANUFACTURE OF MEDICAL EQUIPMENT AND DIAGNOSTIC TEST KITS AT 3795 WASHINGTON BOULEVARD, BEAUMONT, JEFFERSON COUNTY; TEXAS. WHEREAS, the Planning and Zoning Commission of the 111"'ity of Beaumont considered the issuance of a specific use permit to allow the manufacture of medical equipment and diagnostic test kits at 3795 Washington Boulevard, Beaumont, Jefferson County, Texas, to Tipton L. Golias, prospective buyer, his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow the manufacture of medical equipment and diagnostic test kits at 3795 Washington Boulevard, Beaumont, Jefferson County, Texas, in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, is hereby granted to Tipton L. Golias, prospective buyer, his legal representatives, successors and assigns for that certain tract I' described on Exhibit 11A61 attached hereto and made a part hereof for all purposes. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3 . Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. C O M M E N T Attached is copy of signed memo and revised site plan showing approval by the Planning Director, Kirt Anderson, of an amended specific use permit originally granted to Helena Laboratories on January 5, 1988. This amended site plan dated May 3, 1989 is authorized under Sec. 30-26 I. of the Zoning Ordinance. Please attach to the original ordinance. City Code) C O M M E N T Helena Laboratories has submitted a site plan and a construction plan for an owner identification sign to the Planning Division as part of a formal request to amend the specific use permit originally granted by the City Council January 5, 1988 and amended administratively by the planning director on April 5, 1988. The new Helena facility is the former site of Wickes Lumber Co. The original specific use permit specified that Helena would remove the old structural supports previously used for the lumber company sign and mount a building sign on the front of the existing building. Helena is requesting administrative approval to use the existing structural support for a sign measuring 8 Ft. by 24 Ft. The overall height of the sign will be 36 Ft. from top of sign to grade. The site plan indicates that the structural support for the identification sign is thirty (30) feet from the north property line of the tract and that the sign will be located approximately in the center of the tract, 120 feet distant from the west property line. The height of the sign and the setbacks meet the sign regulations found in Sec. 30-28 of the Zoning Ordinance for owner identification signs in the GC-MD (General Commercial-Multiple Family Dwelling) district. The Director of Planning may approve minor variations from the original permit which do not increase density, change traffic patterns, or result in any increase in external impact on adjacent properties or neighborhoods. This tract (5.5 acres) fronts upon Washington Blvd., a major arterial street. There is commercial zoning, commercial development and vacant commercial property adjacent to and surrounding this site. The sign as proposed will cause no adverse effect to neighboring properties nor incre se .n external impact on adjacent land. DATE: April 5, 1988 TO: File 1066-P/Helena Laboratories SUBJECT: Amendment to The Approved Specific Use Permit COMMENT Helena Laboratories has submitted a site plan for their Tax Abatement program showing two curbs cuts along Municipal Drive. The property has 904.67 feet of frontage along Municipal Drive. The northern curb cut is existing and is _ proposed for employee and visitor access to the facility site. The southern cut is a new proposed cut to be used solely for truck traffic and will be built to truck standards. The southern cut accesses directly to the proposed loading dock. In order for the Planning Director to administratively amend the approved specific use permit, the driveways need to be approved by Traffic as not significantly changing the traffic patterns. The Traffic Engineer has approved the curb cuts. In addition, there must be no external impact on the adjacent properties or an increase in the density of development. The curb cuts will not impact any of the adjacent properties since none access Municipal Drive along this area. Municipal Drive does currently handle truck and bus traffic on a regular basis.
