ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE
PERMIT FOR A TWO-FAMILY DWELLING AN AN RS
(RESIDENTIAL SINGLE FAMILY DWELLING) ZONING
DISTRICT ON PROPERTY LOCATED AT 638-640 LAVACA
STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the Planning and Zoning Commission of the City
of Beaumont considered the issuance of a specific use permit for
a two-family dwelling in an RS (Residential Single Family
Dwelling) zoning district on property described as Lot 1 , Block
1 , University Place 2nd Addition and located at 638-640 Lavaca
Street, Beaumont, Jefferson County, Texas, to Russell J. Long,
property owner, his legal representatives, successors, and
assigns for that certain property hereinafter described subject
to the following conditions;
1 ) The application complies with the eight conditions
necessary for approval of a specific use permit;
2 ) That the property owner apply for and receive a
variance from the Board of Adjustment reducing the lot
area requirements for a two-family dwelling, as
required in the Zoning Ordinance.
and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That all conditions necessary for issuance of a specific
use permit have been met and a specific use permit to allow a
two-family dwelling in an RS (Residential Single Family Dwelling)
zoning district on property located at 638-640 Lavaca Street,
Beaumont, Jefferson County, Texas, is hereby granted to Russell
J. Long, property owner, his legal representatives, successors
and assigns for that certain tract described on Exhibit "A"
attached hereto and made a part hereof for all purposes.
Section 2.
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes subject to the receipt of a variance from the Board
of Adjustment regarding the minimum lot area requirements of
Chapter 30 of the Code of Ordinances of the City of Beaumont.
Section 3.
Notwithstanding the site plan attached hereto, the use of
the property hereinabove described shall be in all other respects
subject to all of the applicable regulations contained in Chapter
30 of the Code of Ordinances of Beaumont, Texas, as amended.
