ENTITLED AN ORDINANCE AMENDING A SPECIFIC
USE PERMIT TO ALLOW THE CONSTRUCTION OF
MISCELLANEOUS PROFESSIONAL OFFICES IN AN
AREA ZONED RM-H (RESIDENTIAL MULTIPLE
FAMILY DWELLING-HIGHEST DENSITY DISTRICT)
FOR PROPERTY BEING AN 8.67 ACRES, MORE OR
LESS, REFERRED TO AS PART OF TRACT 6 OUT OF
TRACT 55, TAX ROLL PLAT SP-1, H. WILLIAMS
SURVEY, ABSTRACT NO. 56, BEAUMONT, JEFFERSON
COUNTY, TEXAS.
WHEREAS, on January 5, 1993 City Council approved Ordinance 93-2 issuing a
Specific Use Permit for professional offices on 7.92 acres located south of a 100' wide
Drainage District #6 ditch on the southwest portion of a 15.8 acre tract located within a
22.58 acre tract of land described as Tract 6 out of Tract 55, Tax Roll Plat SP-1, H. Williams
Survey, Abstract 56, Beaumont, Jefferson County, Texas, to James Gonzales, Trustee, his
legal representatives, successors; and,
WHEREAS, the new owner, Mark W. Whiteley and Associates for Prudential
DuPerier Real Estate, wishes to amend the specific use permit to reduce the number of
buildings from 16 to 13 on an 8.67 acre tract with four of the buildings will lying north of the
100' wide ditch; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the issuance of an amended specific use permit to reduce the number of
buildings for professional offices on an 8.67 acre tract of land referred to as part of Tract
6 out of Tract 55, Tax Roll Plat SP-1, H. Williams Survey, Abstract No. 56, as described in
exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas; and,
WHEREAS, the City Council is of the opinion that the issuance of such amended
specific use permit is in the best interest of the City of Beaumont and its citizens, subject to
the hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
THAT Ordinance 93-2 granting a Specific Use Permit, as described on Exhibit "A" attached
hereto and made a part hereof for all purposes be, and it is hereby, amended to reduce the
number of professional offices.
Section 2.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations contained
Oridinance 93-2 and in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.

SUBJECT: Minor variation to an amended specific use permit
COMMENT
A specific use permit was granted by Ordinance No. 93-2 on January 5, 1993 to
allow 16 small office buildings on 7.92 acres in the H. Williams Survey situated
within an RM-H District.
This specific use permit, after a public hearing, was amended by Ordinance No.
93-61 on October 26, 1993 to reduce the number of buildings from 16 to 13, to
be developed on 8.67 acres of land in the H. Williams Survey. The amended
specific use permit divided the 8.67 acres into Areas "A", "B" and "C". Area
"C" was approved for four buildings with a total area of not more than 20,000
sq. ft. and one driveway outlet onto Dowlen Road.
The property owners have made a request for a minor variation for Area "C".
They wish to increase the total number of 1-story office buildings from four to
six with no increase in the original 20,000 sq. ft. total building area. As
approved by Ordinance No. 93-61, only one driveway outlet onto Dowlen will
be constructed. Interior drives will be private. Landscaping, drainage, parking
layout and other ordinance and specific use permit requirements will be as
regulated or approved in the permit. The traffic engineer for the city has seen
and verbally approved the new design.
Area "C" is also the tract that is now being considered as a preliminary
subdivision plat as Dowlen Park North, Lots 10-15, 3.76 acres. The plat is to
be considered by the Planning Commission on August 1, 1994. The plat may be
approved with certain conditions which will be addressed by the staff at the
regular Planning Commission meeting in August.

Article 3, Supplemented Provisions of Section 30-36, Specific Use Permits,
paragraph (i) states that "the procedure for amendment of a specific use permit
shall be the same as for a new application, provided, however, that the Director
of Planning may approve minor variations from the original permit which do not
increase density, change traffic patterns, or result in any increase in external
impact on adjacent properties or neighborhoods.
Howell and Davis, Consulting Engineers, Inc., submitted a print dated July 11,
1994, requesting a "minor amendment" to the amended specific use permit
previously approved for Area "C". Staff has determined that the request meets
the requirements of Section 30-26(i)for a minor variation which can be approved
by the Planning Director. This approval does not affect the approval, conditional
approval or disapproval of the preliminary plat of the Dowlen Park North
Subdivision which is to be considered by the Planning Commission on August 1,
1994.
