ENTITLED AN ORDINANCE GRANTING A SPECIFIC
USE PERMIT FOR A PROPOSED DENTAL OFFICE IN
THE 3500 BLOCK OF DELAWARE, SOUTH SIDE, 430
FEET WEST OF EASTEX FREEWAY IN BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a Specific
Use Permit to Jerry L. Burd to allow construction of a one-story brick building for use as
a dental office in the 3500 block of Delaware, south side, 430 feet west of Eastex Freeway,
as described in Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met and
a specific use permit to allow construction of a one-story brick building for use as a dental
office in the 3500 block of Delaware, south side, 430 feet west of Eastex Freeway,
Beaumont, Jefferson County, Texas, is hereby granted to Jerry L. Burd, his legal
representatives, successors and assigns for that certain tract described on Exhibit "B"
attached hereto and made a part hereof for all purposes, subject to the above conditions.
Section 2.
That the specific use permit herein granted is expressly issued for and in accordance
with each particular and detail of the site plan attached hereto as Exhibit "C" and made a
part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

and 228 of the Map Records of Jefferson County, Texas, out of 84,196 square foot tract described
(here and after referred to as a 1.93 acre tract) as described in Film CodJe #100-44-1541 of the
Jefferson County Real Property Records, said 0.062 acre tract being more particularly described
by metes and bounds as follows:
COMMENCING at a 1" iron pipe found in the south line of Delaware Street, being
the northwest corner of Lot 1 of the Northwood Addition, a subdivision in the City
of Beaumont, Jefferson County, Texas, as recorded in Volume 8, Page 160 of the
Map Records of Jefferson County, Texas;
THENCE South 89° 59'59"West, along the said south line of Delaware Street and
the north line of the 1.93 acre tract, a distance of 280.00 feet to a 5/8" iron rod set
for the northeast corner of said 0.062 acre tract and the POINT OF BEGINNING;
THENCE South 00° 24' 10" West, a distance of 214.27 feet to a 5/8" iron rod set
on the south line of the said 1.93 acre tract for the southeast corner of said 0.062
acre tract;
THENCE South 89° 59' 07"West along the said south line of the 1.93 acre tract, a
distance of 12.10 feet to a 5/8"iron rod found for the southeast corner of a called
0.49 acre tract and the southwest corner of said 0.062 acre tract;
THENCE North 00° 09' 05" East, along the east line of the said 0.49 acre tract, a
distance of 214.27 feet (called North 00° 05'59" West, 212.91 feet ) to a 5/8" iron

COMMENT
Dr. Burd,D.D.S., has requested through his contractor a building permit to add 564 sq. ft., more or
less,to his existing clinic. Subject property received a specific use permit from City Council on July
27, 1993. The property is zoned RM-H (Residential Multiple Family Dwelling-Highest Density)
District.
The proposed building plan is in compliance with the Zoning Ordinance on amendments to a specific
use permit found in Chapter 30-26(i). The Planning Director, Stephen Richardson, has reviewed the
building permit request and is in agreement that the addition is a minor variation.
Please attach this memo to Ordinance#93-41 to show that a minor variation has been granted.
