ENTITLED AN ORDINANCE PROHIBITING SMOKING IN
CERTAIN CITY-OWNED FACILITIES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 18 of the Code of Ordinances of the City of Beaumont be and the
same is hereby amended to add a new Article IV entitled "Smoking Prohibited" to read as
follows:
"ARTICLE IV. SMOKING PROHIBITED
"Section 18-22. Definitions
"Enclosed Area. Closed in by a roof and walls with appropriate
openings for ingress or egress.
"Smoke or Smoking. Possessing a burning tobacco, weed or other
plant in an indoor, enclosed area.
"Section 18-23. It shall be unlawful for a person to smoke in
indoor, enclosed areas belonging to the City of Beaumont except
the Harvest Club and the arena, hallways and lobby of the Civic
Center.
"Section 18-24. Prior to enforcement of Section 18-23 in a City
facility, the City shall post signs clearly disclosing that the area is a
non-smoking area. The information that is required to be provided
under this subsection may be furnished in any one or more of the
following manners as applicable:
1) By conspicuously posting signs in the exception area which
clearly delineate the bounds of the exception area and state that
smoking is permitted therein.
"2) If the entirety of the enclosed area has been designated as a
no smoking area, by posting a sign at each entrance thereto
indicating that smoking is prohibited.
"3) If the entirety of the enclosed area has been designated as an
exception area, by posting a sign at each entrance thereto clearly
indicating the bounds of the exception area and stating that
smoking is permitted therein."
Section 2.
That if any section,subsection,sentence, clause or phrase of this ordinance,
or the application of same to a particular set of persons or circumstances, should for any
reason be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are declared
to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith are repealed to
the extent of the conflict only.
Section 4.
That any person who violates any provision of this ordinance shall, upon
conviction, be punished as provided in Section 1-8 of the Code of Ordinances of the City of
Beaumont, Texas.
