REQUESTED ACTION: Council consider a request for the abandonment of a 430' section of
Burt Street, abandonment of a general utility easement in Block F,
Oakwood Addition and re-dedication of a 50' section of Fulton

RECOMMENDATION
The Administration recommends approval of the request for the abandonment of a 430' section of
Burt Street, subject to the retention of a street, drainage and general utility easement, the
abandonment of a general utility easement in Block F, Oakwood Addition and re-dedication of a 50'
section of Fulton Avenue.
BACKGROUND
As part of its continuing redevelopment of this several block area of the Charlton-Pollard
Neighborhood, ExxonMobil is requesting an abandonment of a 430' section of Burt Street, the
abandonment of a general utility easement in Block F, Oakwood Addition and rededication of a 50'
section of Fulton Avenue.
ExxonMobil owns all the property on either side of that 430' section of Burt Street. The Mobil
Federal Credit Union has expressed concerns regarding access to their facility if Burt Street is
abandoned. With the retention of the street, drainage and general utility easement, the City can
ensure access to Mobil Federal Credit Union from Tagore and Burt Streets. The general utility
easement in Block F of the Oakwood Addition was put in place when the 20' wide alley was
abandoned in 1932. ExxonMobd owns all the property on both sides of the utility easement. The
50'section of Fulton Avenue that is to be rededicated was abandoned in June,2003 as part of a larger
abandonment request. At the time, it was thought that an individual lived in a house located on Lot
14, Block lb. However, it has since been discovered that the individual lives on Lot 13, thus
necessitating the need to rededicate the 50' section of Fulton to provide access to that property.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held October 27, 2003,the Planning Commission voted 6:0:1 to approve the
abandonment of a 430'section of Burt Street, abandonment of a general utility easement in Block F,
Oakwood Addition and re-dedication of a 50' section of Fulton Avenue, subject to the retention of
a general utility easement along Burt or move the utilities at the applicant's expense.

None.

ENTITLEDAN ORDINANCE ABANDONING A430'SECTION
OF BURT STREET, A GENERAL UTILITY EASEMENT IN
BLOCK F, OAKWOOD ADDITION AND RE-DEDICATION OF
A 50' SECTION OF FULTON AVENUE IN BEAUMONT,
JEFFERSON COUNTY, TEXAS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
THAT a 430' section of Burt Street and a general utility easement in Block F, Oakwood
Addition in the City of Beaumont, Jefferson County, Texas, as shown on Exhibits "A" and
"B" attached hereto, be and the same are hereby vacated and abandoned, subject to the
retention of a street, drainage and general utility easement for that 430' section of the
abandoned Burt Street; and,
THAT the re-dedication of the 50' section of Fulton Avenue as shown on Exhibits "A" and
"B" attached hereto is hereby accepted.

RECOMMENDATION
The Administration recommends approval of a zone change from RS to GC-MD-2 District for the
property at 2095, 2125, 2155 and 2175 S. Major Drive.
BACKGROUND
A total of four property owners have applied for a zone change to GC-MD or a more restrictive
district for the properties located at 2095,2125,2155 and 2175 S. Major Drive. It is their desire to
operate a variety of commercial businesses ranging from a pottery/crafts/lawn accessory hobby shop
to a hair salon/massage therapy/health products store to a paralegal business to a gift shop/food
service business.
Mr. Charles Collins, at 2125 S. Major, originally submitted an application to rezone his property.
When he visited with his neighbors,he found out that there were several others who were interested
in rezoning,as well. Mr. and Mrs.Donald Kelly(2095 S.Major),Ms.Jill Sheffield(2155 S.Major)
and Mr. and Mrs. Donald Colbert, Sr.joined Mr. Collins in the request.
The Comprehensive P Ian designates this area as a Neighborhood Growth Unit. This concept
designates commercial nodes at the intersections of major thoroughfares. GC-MD zoning is across
Major Drive from the subject property at the southwest corner of Major and Washington. GC.-MD-2
would allow for commercial development but with the added protection of a specific use permit for
each use. Each applicant will need to apply for the appropriate specific use permit.

At a Joint Public Hearing held October 27,2003,the Planning Commission voted 6:1 to approve a

ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE
BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE
ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY
DWELLING) TO GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY
DWELLING-2) DISTRICT FOR PROPERTY LOCATED AT 2095, 2125,
2155 AND 2175 S. MAJOR DRIVE, BEAUMONT, JEFFERSON COUNTY,
TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL
AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned as RS (Residential Single Family Dwelling) District to
GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District for property located at
2095, 2125, 2155 and 2175 S. Major Drive, being Lots 11-14, Block B, Amelia Heights
Addition, City of Beaumont, Jefferson County, Texas, containing 2.96 acres, more or less,
as described on Exhibit"A", and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,

RECOMMENDATION
The Administration recommends approval of a zone change from RS to NC District for the property
at 4490 Bob Street.
BACKGROUND
Mohamed Ahmed is requesting a zone change for a 0.65 acre tract of land at 4490 Bob. The
property is currently developed with a convenience store and barbershop. The convenience store and
barbershop have been there for many years. A previous zoning study rezoned this area for single
family residential uses.
In February, 2003, Mr. Ahmed came to the City to inquire about the possibility of expanding the
barbershop. It was his desire to construct a 12' 6" x 14' addition on the rear of the building. The
expansion would be used for restroom facilities. However,because the property is zoned RS he was
unable to expand a legal non-conforming use. Mr. Ahmed is now requesting this zone change to
allow him to proceed with his addition.
BUDGETARYIMPACT
None.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow a real estate
services/general offices in an RM-H District at 8155 Gladys.
BACKGROUND
Patti Merrill, the applicant and property owner, is wishing to construct a 4,000 sq. ft. building at
8155 Gladys at Galway. The primary tenant will be Homestead Realty,using approximately 1,600
sq. ft. In addition, at least two other lease spaces will be available. An insurance office will likely
occupy one of those spaces.
The appropriate landscape buffers will be provided along the south property line and for the parking
lot. An existing 8'tall wood screening fence is along the south property line. A 14'tall multi-tenant
monument sign will be constructed along the Gladys frontage.
All access will be off of Gladys. There will be no curb cuts on Galway.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held October 27,2003,the Planning Commission voted 7:0 to approve a
specific use permit to allow a real estate services/general offices in an RM-H District at 8155 Gladys.

BACKGROUND
Brandon Hebert,the property owner,is requesting a specific use permit to allow for the construction
of a mini-warehouse facility at 9489 College.
This mini-warehouse facility will consist of 75 non-climate controlled units in approximately 8,500
sq. ft. of buildings. There will be electric gate access and 24 hour video protection.
Commercial uses abut the subject property on the north,west and south sides. This mini-warehouse
facility will be consistent with the other development along this section of College Street.

BACKGROUND
The Linson Street Church of God in Christ is requesting a specific use permit to allow it to construct
a 6,000 sq. ft. church building and related parking on Montrose Avenue, south of Brighton Street.
Pastor Harmon Dent states that church activities will include the Sunday School hour,an 11:00 a.m.
worship service,YPWW(Young People Will Workers),prayer and Bible study,mission activities
and choir rehearsals. In addition, 2-4 revivals a year will be held along with occasional 3:00 p.m.
Sunday services.

Section 30-40. D. of the Zoning Ordinance states the following:
Protest: The City Council shall not amend, supplement, change, modify or repeal any

such change, signed by the owners of twenty(20)percent or more either of the area of the
lots included in such proposed change or of the lots or land immediately adjoining the same
and extending two hundred (200) feet therefrom, except by the favorable vote of three-
fourths (3/4) of all the members of City Council.
This means that in order to approve a zone change or specific use permit when the 20%rule
has been invoked at least six Council members must vote in favor of the Ordinance.

BACKGROUND
Douglas Hill, owner of Rosewood Store,is requesting a specific use permit to allow the parking of
two commercial vehicles at 3225 Park. This request is similar to one request by Roosevelt Frank
at the southeast corner of Harriot and Ector.
Previously, staff had given Mr. Hill permission to allow the parking of the commercial vehicles.
Recently,the City received a citizen complaint about the trucks parking at this site and Mr.Frank's
site. As a result, staff looked at the current situation and determined that a specific use permit is
required. In September, Mr. Frank received a specific use permit to allow a parking lot. Mr. Hill
has now applied for a similar request.
BUDGETARY IMPACT

Community Housing Development Organization,Inc., (BCHDO).
RECOMMENDATION
The Administration recommends that City Council authorize the City Manager to approve an
amendment to a$152,500 contract with the Beaumont Community Housing Development Organization
in the amount of$32,200 to cover increased construction costs in order to conform to new code
enforcement requirements, and the adjustments in homebuyer down payment subsidies.
BACKGROUND
As per Resolution 03-122 dated June 10, 2003, the Beaumont Community Housing Development
Organization(BCHDO)was awarded a contract in the amount of$152,500 for costs associated with
the construction of three (3)new scattered site homes in low/moderate income neighborhoods. The
passage of Texas House Bill 730 (HB730), which establishes a 10-year warranty for structural
components in new housing construction,has resulted in an increase in the cost of construction and the

RECOMMENDP.TION
At the request of Councilperson Audwin Samuel, Administration recommends that Council review
detailed information related to the structure located at 1125 Van Buren and consider allowing the
property owner to rehabilitate it.
BACKGROUND
This structure was presented before City Council on April 22, 2003 with the recommendation of
a raze or repair order. The property owner was given 120 days to complete the repairs or have
a substantial amount of repairs completed. The property owner did not do either so the structure
was condemned and the final notification was mailed to the owner for non-compliance with
council order.
BUDGETARY IMPACT
City may incur the cost of demolition if the structure is not rehabilitated.
PREVIOUS ACTION
The Administration recommended and Council approved a raze or repair order for this structure
on April 22, 2003.
SUBSEQUENT ACTION
If Council grants a time period for rehabilitation, staff will enroll the owner in a new work
program and monitor the progress of work. If the structure is not brought up to code or
substantial progress is not made within the specified time period, the structure will be demolished
without any further notification to property owner or Council action. If Council does not grant
more time, the structure will be demolished.

City Manager and Clean Community Department Director.

COMMENT:
• This structure was tagged on 3/21102.
• Certified notice was issued to all of Mr Arrendondo's mailing addresses on 4/02102.
• One of the notices was sent back to this office, but the one sent to 605 Van Buren was signed for
by Mary B. Arredondo.
• The next cerified notice that was sent went to Tina Henslee who is Mr Arrencdondo's sister,
because Mr Arrendondo thought that if he change ownership the procedures would start over.
Mr Arrendondo was still issued a notice at that time at the 605 Van Buren address in which he
did sign for on 4/07103. This notice was informing them that the structure was to appear before
council on 4/22/03.
• Publication prior to council was on 4/09/03 and 4/16/03.
• The next notice was sent after council meeting to tell Mr. Arrendondo of council order. Mr
Arrendondo was at the council meeting and appealed for time to repair. Council did grant him
120 days to repair, but if no repairs was done the structure was to be demolished.
• Mr Arrendondo did not do any repairs to the structure. He did call a couple of times to ask for
more time but I did not extend the work program because no work had been done. I was at the
property on 8/26/03 to take pictures and nothing had been done. My inspector took more
pictures on 9/06/03 and nothing had been done. I returned to the property 9/10/03 and he has
put some paint on parts of the structure but still no repairs.
• f went to the property on 10/06/03 and the structure has had some more paint put on but still no
repairs. The front and part of the side yard has been cleaned and you are now able to reach
the structure without climbing over debris. The inside of the structure has not been emptied and
there is no way anyone could begin repairs inside until that has been done. I did speak to Mr,
Arrendondo about these things. He told me that he wanted to broad the structure up and then he
would start cleaning out the inside so he can repair. He wants 60 to 90 days. He told me that
he would have help to do the cleanup but he did not say that he would have help with repairs or
with any cost of the repairs. Mr Arrendondo has over$3,000.00 in fine at Municipal court which
we also discussed. This structure is in a bid package awaiting to be awarded.
• Mr Arrendondo has been a repeated offender for years. The Clean Community Department has
had to write Mr Arrendondo up for a number of violation at this address and many other
properties. 1 am sure Mr Arrendondo has good intention but he has yet to comply with any of
them without charges being filed and fines. I think I could say if council were to ride around and
view his properties they could find violations at each one of these properties. Although they
have had some actions taken against them they remain in violation of a City Ordnance. As you
review this packet you will see that Staff and Council has been very fair to Mr Arrendondo. I
have attached several copies for your review and I think that this will be sufficient in helping you
make a recision.
• Staff met with Mr Arrendondo at the property in question again on 10-29-03. He allowed me in
the structure. staff did not see any repairs but he had removed a lot of the clutter and thing that
the structure had been packed with. There are still some things left but you are now able to
move about the inside. There was a scaffold built in the front of the structure that Mr Arrendondo
said that he planned on using this weekend to replace the rest of the roof. I told Mr Arrendondo
that I would not recommend that because at this time the structure is still under a condemnation
order and he would not be allowed a building permit. At the time of this inspection I also noted
that there was a large electrical wire running from his fathers house across a vacant lot to the
rear of Mr Arrendondo's structure and it was connected to the electrical weather head. I told him
that this was very dangerous and it needed to be removed immediately. Mr Arrendondo said
that he would have it removed by 11-01-03.

The following is recent summary of the events concerning 1125 Van Buren and its' owner Mr. Alfred Arredondo.
10/06/00 Neighborhood Services Division issued a notice to Mr Arredondo for violation of City
ordinanc_�s pertaining to litter and junk motor vehicles. (Litter Complaint# 187706,JMV
Complaint# 187680) Mr. Arredondo remove the junk motor vehicle before court action was
necessary.
Court Actions
Since December 5, 2000, Neighborhood Services Division has filed charges on Mr. Arredondo
for failure to retrieve litter on eight occasions. Mr Arredondo was found guilty of two counts of
failing to retrieve litter by a Municipal Court Jury on April 12, 2001. He was also found guilty
by a Municipal Court Jury on five counts of failing to retrieve litter on April 1, 2003. Mr.
Arredondo currently has been fined a total of$2,086 because of the conditions of 1125 Van
Buren.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Ordinance 03-029 be and the same is hereby amended to amend Sections 1
to remove number 32. -- 1125 Van Buren.
Section 2.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4
of the Standard Building Code, it is hereby ordered that the owner or owners of the building
located at 1125 Van Buren immediately enter into a work program and either demolish or
repair such structure within days of the effective date of this ordinance.
If the owners fail or refuse to repair or demolish the structure within the time limit set
herein, the City is authorized to demolish the structure without further Council action.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, orthe
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

RECOMMENDATION
The Administration recommends approval of agreements with the Southeast Texas Family Resource
Centerto assist with administrative and operating expenses forKids in Motion Safe Haven inthe amount
of$34,212, College For Texans in the amount of$1,830 and Computer Education in the amount of
$1,080. Programs ofthe Charlton-Pollard Weed and Seed Initiative are designed to promote job skills,
learning opportunities and education for persons living in and around the Charlton-Pollard neighborhood.
BACKGROUND
The U. S.Department ofJustice,Executive Office for Weed and Seed under the Title I ofthe Omnibus
Crime Control and Safe Streets Act of 1968 approved the budget for Grant Award#2001-WS-QX-
0021. The Weed and Seed Steering Committee approved funding for these activities on the 21"day of
October, 2003.

BACKGROUND
In January, 1999, the City Council passed a resolution authori zing the city to apply for matching
funds for a traffic safety "Safe and Sober S. T. E. P." grant project. The Police Department has
successfully applied for and the City Council approved several traffic safety grants since that one.
This grant application will provide funding for a"FY2004 S. T. E. P. Wave" grant program. The
grant would be in the amount of twelve thousand, four hundred ninety three dollars ($12,493.00)
from the Texas Department of Transportation without a requirement of any city"match"funding.
BUDGETARYIMPACT
City would receive grant funding in a total amount of twelve thousand, four hundred ninety three
dollars, ($12,493.00)with no required city match funding.
