ORDINANCE NO.
ENTITLED AN ORDINANCE GRANTING A SPECIFIC
USE PERMIT TO ALLOW A "BED AND BREAKFAST"
LODGING FACILITY AT 2298 MCFADDIN AVENUE ON
LAND ZONED RCR (RESIDENTIAL CONSERVATION
REVITALIZATION DISTRICT) FOR .547 ACRES, MORE
OR LESS, BEING ALL OF LOTS 14, 15 AND 16, BLOCK 5,
AVERILL ADDITION TO THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific use
permit to Karl D. Duerr to allow a "Bed and Breakfast" lodging facility at 2298 McFaddin
Avenue on land zoned RCR (Residential Conservation Revitalization District) on .547 acres,
more or less, being all of lots 14, 15 and 16, Block 5, Averill Addition to the City of
Beaumont as shown on Exhibit "A" attached hereto, in Beaumont, Jefferson County, Texas;
and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific use permit have been met and
a specific use permit to allow a "Bed and Breakfast" lodging facility on land zoned RCR
(Residential Conservation Revitalization District) on .547 acres, more or less, being all of
lots 14, 15 and 16, Block 5, Averill Addition to the City of Beaumont as shown on Exhibit
"A" attached hereto, in Beaumont, Jefferson County, Texas is hereby granted to Karl D.
Duerr, his legal representatives, successors and assigns for that certain tract described on
Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the above
conditions.
Section 2.
That the specific use permit herein granted is expressly issued for and in accordance
with each particular and detail of the site plan attached hereto as Exhibit 'B" and made a
part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property hereinabove
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.

me, and being more fully described as Lot No. Fourteen (14), Fifteen (15), and
Sixteen (16), in Block No. Five (5) of AVERILL ADDITION to the City of Beaumont,
Jefferson County, Texas, according to the map or plat of record in Vol. 1, page'
131 Map Records in the office of the County Clerk of said County and State. This
property is located in Zone "C" on the Flood Insurance Rate Map of Beaumont, Texas,
Community-Panel No. 485457 0020B, and is not within the 100 year flood boundaries
according to said map. The Census Tract No. is 11. There is encroachment of
fence into street right-of-way as shown.
