ENTITLED AN ORDINANCE ORDERING A GENERAL
ELECTION TO BE HELD IN THE CITY OF BEAUMONT
ON THE 7TH DAY OF MAY, 1994, AS PROVIDED BY
LAW, FOR THE PURPOSE OF ELECTING A MAYOR
AND TWO (2) COUNCILMEMBERS-AT-LARGE;
PROVIDING FOR PLACES WHERE SUCH ELECTION
SHALL BE HELD; APPOINTING AN EARLY VOTING
BALLOT BOARD FOR EARLY VOTING; APPOINTING A
MANAGER AND JUDGE OF THE CENTRAL COUNTING
STATION; PROVIDING FOR NOTICE THEREOF;
ORDERING A RUNOFF ELECTION IF NECESSARY TO
BE HELD ON THE 21ST DAY OF MAY, 1994;PROVIDING
FOR JOINT ELECTION WITH THE BEAUMONT
INDEPENDENT SCHOOL DISTRICT; PROVIDING FOR
SEVERABILITY AND PROVIDING FOR REPEAL.
WHEREAS, under the provisions of the Charter of the City of Beaumont and
the laws of the State of Texas relating thereto, a regular general municipal election is
required to be held in the City of Beaumont on May 7, 1994. The election shall be for the
positions of Mayor and two (2) Councilmembers-At-Large.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That in accordance with the provisions of the Charter of the City of Beaumont
and the laws of the State of Texas relating thereto, there shall be held in the City of
Beaumont on May 7, 1994, a regular municipal election for said City for the purpose of
electing a Mayor and two (2) Councilmembers-At-Large.
Section 2.
That legally qualified voters residing within the corporate limits of the City of .
Beaumont shall be entitled to a vote at said election.

Section 3.
That said election shall be held in the City of Beaumont between the hours
of 7:00 a.m. and 7:00 p.m. at the places listed in Exhibit "A" attached hereto and made a
part hereof for all purposes and the persons whose names appear in Exhibit "A" are
appointed presiding judges and alternates for the respective voting boxes with authority to
select and appoint clerks.
The presiding judge for each election precinct shall appoint two (2) clerks and
the City Clerk may authorize as many additional clerks as are deemed necessary for the
proper conduct of the election.
Section 4.
That said election shall be held and the qualifications of those voting thereat
shall be controlled by the provisions of the Texas laws governing elections.
Section 5.
That notice of said election shall be given by publishing said notice as set out
herein in a newspaper of general circulation in this city and county one (1) time, not more
than thirty (30) days nor less than ten (10) days before said election. Said notice shall be
in the following form:
"NOTICE OF A GENERAL MUNICIPAL ELECTION IN
THE CITY OF BEAUMONT FOR THE PURPOSE OF
ELECTING A MAYOR AND TWO ( 2)
COUNCILMEMBERS-AT-LARGE."
"Notice is hereby given that a general municipal election, as
provided by the Charter of the City of Beaumont and the
statutes of the State of Texas, will be held in the City of
Beaumont on the 7th day of May, 1994, from 7:00 a.m. to 7:00
p.m. for the purpose of electing a Mayor and two
Councilmembers-At-Large."

That one copy of said notice shall be filed with the County Clerk of Jefferson
County, Texas and another copy shall be posted on a bulletin board in the office of said
County Clerk at least twenty (20) days prior to said election.
Section 6.
That the official ballot for the registering of the vote of the voters shall be as
follows:

Section 7.
That an electronic voting system, as described by Title 8 of the Texas Election
Code, shall be used for said election and the following are hereby appointed officers of said
election to serve at the Central Counting Station which is hereby established at the Jefferson
County Mid-County Building: Manager of the Central Counting Station, Tom Lawrence;
Tabulation Supervisor, Bob Crane; Presiding Judge of the Central Counting Station,
Rosemarie Chiappetta. The official ballot cards and ballot labels, respectively, for the
election shall be prepared in accordance with the Texas Election Code. Early voting shall
be conducted by a clerk for Early Voting, namely Rosemarie Chiappetta, the City Clerk.
Early voting by personal appearance shall be conducted at the City Hall, Room 125, 801
Main Street, Beaumont, Texas, 77701. Early voting ballot applications and ballots voted by

mail may be sent to the City Clerk's Office, P. O. Box 3827, Beaumont, Texas, 77704. Said
clerk shall keep said office open for at least eight (8) hours between 8:00 a.m. and 5:00 p.m.
on each day for early voting which is not a Saturday, a Sunday, or an official State holiday;
provided, however, except as authorized by Section 85.005(a), Texas Election Code, said
clerk shall not permit anyone to vote early by personal appearance on any day which is not
a regular working day for the clerk's office, and under no circumstances shall she permit
anyone to vote early by personal appearance at any time when her office is not open to the
public.
That early votes by personal appearance and by mail shall be counted by an
early voting ballot board consisting of a presiding judge and three clerks and the City Clerk
may authorize as many additional clerks as are deemed necessary. Dolores Lawless, 495
Yorktown, is hereby appointed Presiding Judge of the.Early Voting Ballot Board and she
shall appoint the clerks.
Section 8.
That in accordance with the laws of the State of Texas, a runoff election, if
necessary to elect a Mayor, is ordered to be held on the 21st day of May, 1994, between the
hours of 7:00 a.m. and 7:00 p.m., to be held at the same voting locations and with the same
election officers and judges as the general election.
Section 9.
That notice of the runoff election, if necessary to elect a Mayor, shall be given
by publishing said notice as set out herein in a newspaper of general circulation in this city
and county one (1) time, not later than the 10th day before election day. Said notice shall
be in the following form:

"NOTICE OF A RUNOFF ELECTION IN THE CITY OF
BEAUMONT FOR THE PURPOSE OF ELECTING A
MAYOR."
"Notice is hereby given that a runoff election, as provided by the
Charter of the City of Beaumont and the statutes of the State
of Texas, will be held in the City of Beaumont on the 21st day
of May, 1994, from 7:00 a.m. to 7:00 p.m. for the purpose of
electing a Mayor."
That one copy of said notice shall be filed with the County Clerk of Jefferson
County, Texas, and another copy shall be posted on a bulletin board in the office of said
County Clerk at least ten (10) days prior to said election.
Section 10.
That the general election shall be held jointly with the Trustee Election of the
Beaumont Independent School District. The Beaumont Independent School District will
hold an election jointly with the City of Beaumont in twenty (20) election precincts as set
out in the Order calling such election for three (3) trustees for the Beaumont Independent
School District. The election shall be held in accordance with the following terms of
agreement between the City of Beaumont and the Beaumont Independent School District:
a) The expenses of the election within joint precincts shall
be divided with each governmental entity paying an equal
share of said expenses.
b) Single ballot forms shall be used which shall contain the
Mayor and Councilmember-At-Large positions and BISD
Trustee positions.
c) The herein-named election officers shall conduct the
elections in said election precincts.
d) Records for all elections shall be combined. -
e) One set of ballot boxes and stub boxes for all
elections shall be used.

f) Election returns shall be made on joint forms but the
City Council of the City of Beaumont shall canvass
the returns of the General Municipal Election.
g) The City Clerk of the City of Beaumont is designated
custodian of all records and of the voting ballots.
Section 11.
That a copy of this ordinance, both in the English language and in the Spanish
language, signed by the Mayor of the City of Beaumont, Texas and attested by the City
Clerk of said city, shall constitute the notice ordering said election and the City Clerk is
directed to cause a copy of this ordinance, signed by the Mayor and attested by her, to be
posted at the City Hall in the City of Beaumont, Jefferson County, Texas, said posting to be
not less than twenty days prior to said election and to cause a copy of this ordinance to be
published on the same day in each of two successive weeks in some newspaper of general
circulation in the City of Beaumont, said publication to be made in accordance with State
law, the first such publication to be made not less than fourteen days before the date of said
election.
Section 12.
That this ordinance shall be finally passed on the date of its enactment and
shall take effect immediately upon its passage and signature by the Mayor. The City Clerk
is hereby authorized to attest to same and to affix the seal of the City of Beaumont hereto.
Section 13.
That if any section, subsection, sentence, clause or phrase of this ordinance,
or the application of same to a particular set of persons or circumstances,should for any
reason be held to be invalid, such invalidity shall not affect the remaining portions of this

ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 14.
That all ordinances or parts of ordinances in conflict herewith are repealed to
the extent of the conflict only.

PROVEIDO POR LEY, CON EL PROPOSITO DE ELEGIR UN MAYOR Y DOS
2CONSEJALES SIN LIMITES, PROVEYENDO LUGARES DONDE TENER TAL
ELECCION: NOMBRANDO JUNTA DE REVISAR PARA LA VOTACION DE LOS
QUE VOTAN TEMPRANO; NOMBRANDO GERENTE Y JUEZ DE LA ESTACION
CENTRAL DE CONTAR; PROVEYENDO AVISO DE ESTO; DECRETANDO
ELECCION DE DESEMPATE, SI NECESARIA QUE LA TENGA. eL DIA 21 DE

EN VISTA DE QUE, bajo las provisions de la Carta Constitutional de la Ciudad de
Beaumont y las leyes del Estado de Texas a esto pertmcnte una elecci6n general municipal
se requiere que se la tenga en la Ciudad de Beaumont el d1a 7 de mayo, de 1994, La eleccidn
sera por los puestos de Mayor y dos (2) Consejeros Sin Li rites.
AHORA, POR ENDE, SEA DECRETADO POR LA
CIUDAD DE BEAUMONT
Seccion 1.
Que de acuerdo con las conditions de la Carta Consticional de la Ciudad de
Beaumont Y las leyes del Estado de Texas, a esto perteneciente que se tendril en la Ciudad
de Beaumont el dia 7 de mayo de 1994 una eleccidn general pars dicha Ciudad con el
proposito de elegir un Mayor y dos Consejales Sim Limites.
Seccion 2.
Que los votantes calificados residiendo dentro de los ldnites corporativos de la Ciudad
seran per mitidos a votar en dicha eleccidn.
Seccion 3.
Que dicha elecd6n en la Ciudad se tendrdentre las horas de 7:00 a.m. y 7:00 p.m.
en los lugares enumerados en Muestra "A" pegada a este y hecha parta de Este para todos
prop8sitos y las personas cuyas nombres aparecen en Muestra "A" estdn nombradas jueces
gobernantes y suplentes para las respectivas rajas de votad4n con la autiridad de nombrar
empleados.
El juez gobcmante de cads distrito electoral les nombrard a dos (2) empleados
adicionales como juzgado necesario para la buena marcha de la elecci6n.

Que dicha e1ecci6n se tenri y las calificadones para los votantes en esta serann
controlladas por las provisions de las leyes de las leyes de Tezas gobernando elections.

Que aviso de dicha election sera dado por publicar dicho saviso como expresado en
este en un peri6dico de circulacidn' general en esta Ciudad y condado una (1) vez nom s
que treinta (30) dias ni menos que diez (10) antes de la election. Dicho aviso serf en la
siguiente forma

BEAUMONT PARA ELEGIR UN MAYOR Y DOS (2) CONSEJALES DIN LIMITES.
"Aviso se da por caste de una eleccicin general municipal como proveido en la Carta
Constiticional de la Ciudad de Beaumont y los estatutos del Estado de Texas, se tendr6 en
la Ciudad de Beaumont el dia 7 de mayo, 1994 desde 7:00 a.m. hasta 7:00 p.m. para el

las horns de 7:00 a.m. y 7:00 p.m. a que se tenga en los mismos lugares de votscidn y con
los mismos funciinarios y jueces como la eleccidn general.
SECCION 9.
Que aviso de la eleccidn de desempate, si necessaria para elegir Mayor, sera daco por
publicar dicho aviso como expuesto en este enperiddico de circulation general en esta Ciudad
y Condado una(1)vez no mks tarde clue el decimo da antes de la eleccidn. Dicho aviso sersa
en la siquiente forma:

Aviso ed dado por este que eleccidn de desempate, como provefdo en la Car
Constitutional de la Ciudad de Beaumont y los estatos del Estado de Texa&serd llevado a
ia'bo en la Ciudad de Beaumont el dfa 21 de mayo, 1994, desde las 7:00 a.m. a 7:00 p.m.
para elegir Mayor.
Que una copia de dicho aviso serd archivada con la Escribana del Condado de
Jefferson, Texas, y otra copia serd pegada en la tabilla en la oficina de dicho cscribano del
Condado a to menos diez (10) divas antes de dicha eleccion).
SECCION 10.
La elecci�n general se tends unida con la Eleccidn de Fidiecomisarios del Distrito
Escolar Independiente Beaumont. El Distrito Escolar Independiente Beaumont tendri
eleccion unida con la Ciudad de Beaumont en vcmte(20)distritos por los tres fideicomisarios
para el Didstrito Escolar Independiente Beaumont. La eleccion se tendril de acuerdo con las
siquientes condiciones de acuerdo entre la Ciudad de Beaumont y ei Distrito Escolar
Independiente Beaumont:
a). Los gastos de la eleccion dentro de los lugares unidos de votacidn serin dividos con
cada entitad govermental pagando parte igual de dichos gastos.
b). Balotas sencillas serdn usadas las cuales tendran los puestos de Mayor y Consejales
Sin finites y los puestos de fideiconisarios de BISD.
c). Los funcionarios nombrandos en cste desarrollardn la eleccion en los lugares de
BISD.
d). Los resultados de todas elecciones seran combinados.
e). Un juego de urnas de balotas y de los talons de balotas ser4-usado para todas
elections.
f). Los resultados de la eleccion serdn hechos en formas unidas pero el Concilio dela
Ciudad de Beaumont revisarl los resultados de la Eleccidn Municipal General.
g). La Escribana de la Ciudad de Beaumont esta designada custodia de todos los
archivos y las balotas votadas.
SECCION 11.
Una copisa de esta ordenanza, en el idioma y en el idioma Espanol, firmada por la
Mayora dela Ciudad de Beaumont, Texas y atestada por la Escibana dela Ciudad de dicha
Ciudad, constiturdel aviso decretando dicha electi6n y la Escriband dela Ciudad esd dirigida
a causar clue copia de dicha ordenanza, fkmada por la Mayora y atestado por ella, a ser pegado
en al Ayuntamiento de la Ciudad de Beaumont, Condad de Jefferson, Texas dicha pegando
a ser no menos que veinte diaas antes de dicha electidn y a causar que copia de esta ordenanza
sea publicada el mismo d�a en cada uno de dos sucesivas semanas en algun peri6dioco de
circulation general en la Ciudad de Beaumont, dicha publicacacion sera hecha no menos que
catorce dl'as antes de la fecha de dicha eleccion.
SECCION 12.
Esta ordenanza serf decretada finalmente en la fecha de su promul gacidn y tomar
vigor inmediatemente al ser decretada y firmada pol la Mayora. La Escribana de la Ciudad
estl por esta autrizada a atestar la misma y de poner el sello dela Ciudad de Beaumnt a este.
SECCION 13.
Que si alguna section, subsecti6n, frase o clausala de esta Ordenanza
o la aplicacion dela misma a un grupo particulasr de personas o circumstancias, suceda por
cualquiera ras'on ser declarada invalida, tat invalidez no efectara las porciones restantes de esta
ordenanza, y a tal fin varias provisions de esta ordenanza estan declaradas severables.
SECCION 14.
Que todas ordenanzas o partes de ordenanzas en conflicto con Eta estdn repeldas al
exteno del conflicto solamente.

de febrero de 1994.
