HomeMy WebLinkAboutORD 94-29 ORDINANCE NO. q - ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY WITHIN THE CITY LIMITS,AND GRANTING THE SAID TERRITORY AND TO ALL INHABITANTS THEREOF ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, two (2) public hearings were held concerning the proposed annexation of the territory described in Exhibit "A' attached hereto for all purposes. Said public hearings were held on March 21, 1994 and March 29, 1994. At the public hearings, all interested persons were provided an opportunity to be heard; and, WHEREAS, such public hearings were held not more than forty (40) days nor less than twenty (20) days prior to the institution of annexation proceedings; and, WHEREAS, notices of such public hearings were published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty (20) nor less than ten (10) days prior to such hearings; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: 1. THAT the land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and described in Exhibit "A' attached hereto and made a part North twenty-two degrees nine minutes seven seconds West (N. 22° 09' 07" W.), a distance of two hundred fifty-seven and eighty-one hundredths feet (257.81'), to a fence post for angle point; North eighteen degrees seven minutes twenty-nine seconds West (N. 18° 07' 29"W.), a distance of three hundred seventy-two and fifty-three hundredths feet (372.53'), to a 1" pipe at fence line for angle point; North twenty-three degrees fifty-seven minutes fifty-two seconds West (N. 23- 57' 52" W.), a distance of three hundred seventy-three and twenty hundredths feet (373.20'), to a fence post for angle point; North twenty-three degrees thirty-nine minutes thirty-eight seconds West (N. 23o 39' 38" W.), a distance of eight hundred seventy and seventy-eight hundredths feet (870.78'), to a fence post for angle point; North twenty-one degrees twenty-six minutes forty-seven seconds West (N. 21° 26' 47" W.), a distance of five hundred twenty-seven and nineteen hundredths feet (527.19'), to a fence post for angle point; North twenty-three degrees eleven minutes twenty-three seconds West (N. 23° 11' 23" W.), a distance of seven hundred sixty-one and seventy- seven hundredths feet (761.77'), to a fence post for angle point; North twenty-nine degrees eleven minutes thirty-eight seconds West(N. 290 11' 38" W.), a distance of seventy-one and twenty hundredths feet (71.20'), to a fence post for angle point; North sixty degrees twenty-three minutes thirty-two seconds West (N. 60o 23' 32" W.), a distance of five hundred eighteen and one hundredths feet (518.01') to a fence post for angle point; North sixty-seven degrees three minutes three seconds West (N. 67 03' 03" W.), a distance of two hundred thirty-one and seventy-one hundredths feet (231.71'), to a fence post for angle point; North seventy-seven degrees five minutes forty-two seconds West (N. 770 05' 42" W.), a distance of three hundred six and thirteen hundredths feet (306.13'), to a fence post for angle point; North eighty-four degrees forty-nine minutes three seconds West (N. 84o 49' 03" W.), a distance of three hundred ten and sixty-eight hundredths feet (310.68'), to a fence post for angle point; North seventy-five degrees forty-six minutes forty-six seconds West (N. 75° 46' 46" W.), a distance of four hundred seventy-nine and thirty-one hundredths feet (479.31'), to a fence post for angle point; South forty-nine degrees forty-nine minutes thirty-one seconds West(s. 49- 49' 31" W.), a distance of two hundred seventy-eight and fourteen hundredths feet (278.14'), to a fence post for angle point; South sixty-five degrees six minutes eleven seconds West (s.65 0 06' 11" W.), a distance of five hundred sixty-two and two hundredths feet (562.02'), to a fence post for angle point; South fifty-nine degrees forty-five minutes twenty-three seconds West (s. 590 45' 23" W.), a distance of eight hundred sixty-eight and eighteen hundredths feet (868.18') to a 1" pipe in the west line of the C. Corzine Survey, Abstract 14, said pipe being the southwest corner of the herein described tract; THENCE North three degrees forty-three minutes forty-three seconds West (N. 03° 43' 43" W.), along a fence line and along the common lines of the C. Hillebrandt and S. Corzine Surveys, a distance of one thousand seven hundred fourteen and eighty-eight hundredths feet (1,714.88') to a 1" pipe for angle point, one and seventy hundredths feet (1.70') west of a concrete monument; THENCE North three degrees thirty minutes thirty-seven seconds West (N. 03 G 30' 37" W.), continuing along said common survey line, a distance of three thousand ninety-five and eighty-eight hundredths feet (3,095.88') to an angle point on the south bank of Willow Marsh Bayou; THENCE North three degrees twenty-eight minutes twenty-seven seconds West, (N. 03° 28' 27" W.), crossing Willow Marsh Bayou and continuing along said common survey line, a distance of two thousand one hundred thirty-nine and ten hundredths feet (2,139.10') to a 1" pipe for corner at the northeast corner of the S. Corzine Survey, same being the southeast corner of the S. A. Cameron, et al, to Nona Mills Company recorded in Volume 89, Page 636 of the Deed Records of Jefferson County, Texas, and other said deed being from J. M. McClure to Nona Mills Company recorded in Volume 89, Page 639 of the Deed Records of Jefferson County, Texas; said herein described tract being more fully described as follows: BEGINNING at a 3/4" pipe at a fence corner which marks the northwest corner of the C. Hillebrandt Survey and the southwest corner of the James Rowe Survey, Abstract 45, said corner also being the northwest corner of the tract herein described and being in the east line of the S. Stivers Survey, Abstract 51 and in the east line of Tyrrell Park and the city limit line of the City of Beaumont; THENCE North eighty-six degrees thirty minutes fifty-six seconds East (N. 86o 30' 56" E.), along the north line of the C. Hillebrandt Survey and the south line of the J. Rowe Survey and along an old fence line, a distance of five thousand five hundred seventy-eight and forty-nine hundredths feet(5,578.49') to a concrete monument for corner; THENCE South three degrees zero minutes fifty-four seconds East(S.03° 00' 54" E.), continuing along an old fence, a distance of three thousand one hundred ten and twenty-four hundredths feet (3,110.24') to a 1-1/2" pipe for corner; THENCE North eighty-seven degrees sixteen minutes thirty-eight seconds East (N. 87- 16' 38" E.), along the general line of the old fence, a distance of one thousand four hundred seventy-seven and seventy-six hundredths feet (1,477.76') to a 1" galvanized pipe for corner, in the west line of the M. Grange Survey, Abstract 26 and the east line of the C. Hillebrandt Survey, twelve and ninety-eight hundredths feet (12.98') south of a concrete monument, said monument being the northwest corner of the M. Grange Surveys; THENCE North eight-nine degrees forty-four minutes fifty-six seconds West (N. 89° 44' 56" W.), along a fence line to the east bank of Hillebrandt Bayou, crossing said bayou and along the north edge of a portion of the abandoned bayou, a distance of nine hundred eighty-four and three hundredths feet (984.03') to a point for corner; EXHIBIT "A" THENCE in a westerly and southerly direction along the north edge of the abandoned bayou, the following courses and distances: South eighty-six degrees thirty-one minutes fifty seconds West (S. 86 31' 50" W.), a distance of two hundred seventy-two and fifteen hundredths feet (272.15'), for angle point; North eighty-six degrees twenty-nine minutes seventeen seconds West (N. 86- 29' 17" W.), a distance of one hundred forty-two and zero hundredths feet (142.00'), to a 1" bent pipe for angle point; South eighty degrees forty-six minutes fourteen seconds West (S. 80° 46' 14" W.), a distance of one hundred seventeen and eighty-three hundredths feet (117.83'), for angle point; South thirty-six degrees forty-nine minutes forty-five seconds West (S. 360 49' 45" W.), a distance of one hundred sixty and zero hundredths feet (160.00'), to a 1" bent pipe for angle point; South twenty-one degrees fifteen minutes fifteen seconds West (S. 21 15' 15" W.), a distance of two hundred thirty-two and one hundredths feet (232.01'), to a 1" pipe for angle point at a fence line running generally east and west; THENCE in a westerly and north direction, along the fence line, the following courses and distances: North seventy-nine degrees nineteen minutes seventeen seconds West (N. 79- 19' 17" W.), a distance of one hundred sixty three and sixty- seven hundredths feet (163.67'), to a fence post for angle point; North sixty degrees twenty minutes thirty-five seconds West (N. 60° 20' 35" W.), a distance of two hundred fifty and eight-two hundredths feet (250.82'), to a fence post for angle point; North fifty-eighty degrees eleven minutes fifty-eight seconds West (N. 580 11' 58" W.), a distance of four hundred seventy-six and forty-four hundredths feet (476.44'), to a fence post for angle point; North forty-two degrees seventeen minutes ten seconds West (N. 42 17' 10" W.), a distance of one hundred fifty and seventy-six hundredths feet (150.76'), to a fence post for angle point; North thirty-three degrees one minute thirty-nine seconds West(N.33 01' 39" W.), a distance of three hundred three and forty-three hundredths feet (303.43'), to a fence post for angle point; hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas; said territory shall hereinafter be included within the boundary limits of the City of Beaumont, Texas; the present boundary limits of such City at the various points contiguous to the area hereinafter described in Exhibit "A", are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas, such property shall be within Ward 2 for purposes of municipal elections. 2. The described territory in the area so annexed shall be a part of the City of Beaumont, Texas, and the inhabitants thereof, if any, shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Beaumont, Texas.
