ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
TO REGULATE GARAGE SALES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30, Section 30-4(b) of the Code of Ordinances of the City of Beaumont
be, and the same is hereby, amended to add a new definition entitled "Garage Sales" to read
as follows:
Sec. 30-4(b).
Garage Sale: Sale of used household or personal articles such as furniture, tools, or
clothing held on the seller's premises. Yard sales, sidewalk sales,
rummage sales, estate sales and similar activities are considered garage
sales and are classified under Used Merchandise Stores, SIC Group
#593.
Section 2.
That Chapter 30, Section 30-24(b) of the Code of Ordinances of the City of Beaumont
the same being the Permitted Use Table be, and the same is hereby amended to add the number
"21" under the column headed "Special Conditions" and the number "14" under the column
headed "Parking Group" for SIC group #593 "Used Merchandise Stores".
Section 3.
That Chapter 30, Section 30-33(b) of the Code of Ordinances of the City of Beaumont
be and the same is hereby amended to add a Special Condition 21 to read as follows:
Sec. 30-33(b).
21. Garage sales are a permitted use in all the residential zoning districts provided
the following conditions are complied with:
a. a garage sale shall not be for more than 3 continuous days;
b. no more than 2 garage sales per calendar year per premises shall be
allowed;
C. hours of operation shall be limited from sunrise to sunset;
d. no merchandise shall be displayed or placed on the public right-of-
way; and,
e. only one unlit sign, no larger than 6 square feet, and set off of the
public right-of-way shall be allowed.
f. garage sales conducted out of a dwelling unit are exempt from the
parking requirements.
Section 4.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be
held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and
to such end the various portions and provisions of this ordinance are declared to be severable.
Section 5.
That all ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.
Section 6.
That any person who violates any provision of this ordinance, shall upon conviction, be
punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
