ENTITLED AN ORDINANCE AMENDING
CHAPTER 21, SECTION 21-6 OF THE CODE
OF ORDINANCES . OF THE CITY OF
BEAUMONT DEALING WITH EMPLOYEES'
VACATION AND PERSONAL LEAVE;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR REPEAL.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 21, Section 21-6 of the Code of Ordinances of the City of Beaumont is
hereby amended to read as follows:
Section 21-6. LEAVE
a. Effective October 1, 1991 regular full time employees shall earn vacation in accordance
with the following schedule.
1.) Vacation Leave

12 to 14 120
15 to 17 132
18 to 20 144
21 to 23 160
24 to 26 172
27 to 29 184

Each regular full time employee shall earn vacation leave only when he/she is paid for
80 hours in the same pay period.
Each regular full time emergency medical services (EMS) employee shall earn a
maximum of 112 hours of vacation leave per year. Each EMS employee shall earn
vacation leave only when the employee is paid for 96 hours in the same pay period.
Earned holiday time may be carried forward and added to vacation leave but accrued
vacation leave not to exceed two hundred forty (240) hours may be carried forward in
the next calendar year.
2.) Personal leave - Effective October 1, 1991 each regular full time employee shall earn
a maximum of 40 hours of personal leave per year. An employee shall earn personal
leave only when the employee is paid for 80 hours in the same pay period.
Each EMS employee shall earn a maximum of 56 hours of personal leave per year. An
EMS employee shall earn personal leave only when the employee is paid for 96 hours
in the same pay period.
3.) Short term disability - Each regular full time employee shall earn a maximum of 96
hours per year of short term disability leave. An employee shall earn short term
disability leave only when the employee is paid for 80 hours in the same pay period.
However, an EMS employee shall earn short term disability leave only when the
employee is paid for 96 hours in that same pay period.
b) An employee may not carry more than 240 hours of vacation leave into the next
calendar year.
c) An employee may not use any accrued vacation until he/she has completed one year of
continuous service with the City. Vacation leave must be approved by the employee's
supervisor before it can be used.
d) Employees who are separated before completing twelve (12) months of continuous
service shall not be entitled to payment for unused vacation leave.
e) An employee who is on leave of absence without pay shall not earn vacation leave
during that period of time.
f) Each regular full time employee may accumulate up to seven hundred and twenty (720)
hours of personal leave, regardless of years of service.
g) Each regular full time employee shall earn personal leave which may be used for illness
or, upon the supervisor's approval, for any purpose.
h) Each regular full time employee who leaves the City after completing twelve continuous
months of service will be paid for accumulated personal leave not to exceed 720 hours.
However, if that employee had short term disability hours accrued prior to October 1,
1991, the payment shall not exceed a combined total of 720 hours of personal and short
term disability leave.
i) An employee may utilize short term disability after being absent for 40 consecutive
hours for the same non-work related illness, injury or disability.
j) An employee may use his/her earned vacation and personal leave or leave without pay
to satisfy the 40 consecutive hours condition. Employees with less than one (1) year's
service may only use personal leave or leave without pay for this purpose.
k) Each regular full time employee may accumulate up to seven hundred and twenty (720)
hours of short term disability leave.
1) Upon termination, an employee shall not be paid for any short term disability hours
which the employee has on the date of termination in excess of the number of hours
existing as of September 30, 1991.
m) An employee who leaves the City after completing twelve months of continuous service
and had accumulated personal leave and short term disability leave prior to October 1,
1991 shall be paid upon termination for such leave not to exceed a combined total of
720 hours. The pay for such unused accumulated hours of short term disability leave
shall be at the employee's rate of pay as of September 30, 1991.
n) Employees who are convicted of malfeasance, theft or a felony shall not receive pay for
any unused personal leave and short term disability.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be
held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and
to such end the various portions and provisions of this ordinance are declared to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith are repealed to the extent of
the conflict only.
