ENTITLED AN ORDINANCE DEFINING THE TERM "POLICE
DEPARTMENT" FOR PURPOSES OF THE MUNICIPAL
RETIREMENT SYSTEM; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL.
WHEREAS, in December of 1969 the City Council passed Ordinance No. 69-89
establishing a contribution rate to the Texas Municipal Retirement System for the Police
Department of the City of Beaumont of seven percent (7%); and
WHEREAS, consistently since that date the intent of the City Council as
established by that ordinance has been to apply the seven percent (7%) contribution rate to
the Police Department of the City of Beaumont, which such department contained and
contains only certified and sworn police officers under the laws of the State of Texas; and
WHEREAS, the City Council desires to memorialize its consistent definition of
"Police Department" to include only certified, sworn police personnel;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY OF BEAUMONT:
Section 1.
That the City of Beaumont hereby recognizes that continually since the passage of
Ordinance No. 69-89, notwithstanding any budget designation to the contrary, the term "Police
Department" has been and shall continue to be defined to include only sworn and certified
police officers as provided under the laws of the State of Texas and shall not include non-
sworn and certified personnel who may act as civilian support personnel to the Police
Department. This determination of the meaning of'Police Department" as used in Ordinance
O-1�D-S9
69-89 is done in accordance with the powers of a home-rule city as established in the home-
rule amendment to the Texas Constitution and its enabling acts. The definition set out herein
is a legislative act of the City of Beaumont and shall apply from and after the effective date
of Ordinance 69-89 and any other ordinance dealing with the retirement system of Beaumont
police officers.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be
held to be invalid, such invalidity shall not affect the remaining portions of this ordinance,
and to such end the various portions and provisions of this ordinance are declared to be
severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
