ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE
PERMIT TO ALLOW A 4TH AND 5TH GRADE LEVEL PUBLIC
ELEMENTARY SCHOOL AT 8950 HOMER DRIVE, BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, the Planning and Zoning Commission of the City
of Beaumont considered the issuance of a specific use permit to
allow a 4th and 5th grade level public elementary school at 8950
Homer Drive, Beaumont, Jefferson County, Texas, to the Beaumont
Independent School District, property owner, its legal
representatives, successors, and assigns for that certain property
hereinafter described, subject to the following conditions;
( 1 ) The Beaumont Independent School District dedicate the
west thirty feet ( 30 ' ) of the school tract for Homer
Drive street right-of-way purposes;
(2) The City of Beaumont agrees to improve White Oak Lane
so that normal vehicular access to the school from
White Oak is possible within two (2) years; and,
(3 ) That, prior to the construction of White Oak, the
street be improved enough to provide access to
emergency vehicles and an escape route for school
patrons. And, in addition, the construction plans
submitted to the City for the school show the private
driveway leading to White Oak, as reflected on the
"Addendum to Site Plan" for the application for a
specific use permit; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of
the City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That all conditions necessary for issuance of a specific
use permit have been met and a specific use permit to allow a 4th
and 5th grade level public elementary school at 8950 Homer Drive,
Beaumont, Jefferson County, Texas, is hereby granted to the
Beaumont Independent School District, property owner, its legal
representatives, successors and assigns for that certain tract
described on Exhibit "A" attached hereto and made a part hereof for
all purposes, subject to the above conditions.
Section 2.
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use
of the property hereinabove described shall be in all other
respects subject to all of the applicable regulations contained in
Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
