ENTITLED AN ORDINANCE APPROVING A LAND USE AND
DENSITY PLAN FOR A TRACT OF LAND LOCATED AT
THE SOUTHWEST CORNER OF EAST ELGIE AND MARTIN
LUTHER KING PARKWAY; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
WHEREAS, Joseph T. Endari, owner of the tract of land
described as Tax Roll Tract 2, Plat B-1 out of the J. W. Bullock
Survey and Lots 11 and 12, Block 12 of the Cloverdale Addition to
the City of Beaumont has filed a land use and density plan allowing
for a neighborhood commercial on the PUD zoned property; and,
WHEREAS, the Planning Commission of the City of Beaumont
has reviewed the application and recommends the approval of the
land use and density plan, as described in Exhibit I attached
hereto for the reasons that a commercial development would be in
accordance with the zoning ordinance; a commercial development
would be in accordance with the comprehensive plan and the MLK
Corridor plan and a specific commercial use will require a specific
use permit (site plan review) as required with the existing PUD
zoning.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
THAT the land use and density plan described in Exhibit I for the
property currently zoned PUD, described as Tax Roll Tract 2, Plat
B-1 out of J. W. Bullock Survey and Lots 11 and 12, Block 5 of the
Cloverdale Addition be, and it is hereby, approved.
Section 2.
Notwithstanding the site plan attached hereto, the use
of the property hereinabove described shall be in all other
respects subject to all of the applicable regulations contained in
Chapter 30 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
Section 4.
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
